Abstract/Description:
This chapter considers the extent to which the European Union (EU) and the European Economic Area (EEA) provide for intellectual property exhaustion principles going beyond those typically found in national laws. Following the Agreement on Trade-Related Aspects to Intellectual Property Rights (TRIPS) of the World Trade Organization (WTO),1 the term “TRIPS-plus” became commonly used to describe and propose international agreements providing for intellectual property protection beyond the TRIPS minimum requirements and was particularly adopted by those opposed to such extension.2
