Abstract/Description:
The chapter addresses questions of liability arising in the context of the conduct of CDSP operations on the basis of the relevant case law and practice. The analysis is conducted at three levels of jurisdiction: public international law, European Union law, and the domestic law of Member States. While most claims relating to the conduct of CSDP operations have traditionally been settled amicably, some case law has recently started to emerge from the Court of Justice of the European Union as well as domestic jurisdictions of the Member States that sheds light on the question of attribution of responsibility and liability between the EU and its Member States.
