Abstract/Description:
The Maltese legal framework presently contains no legislation specifically regulating consumer insolvency procedures and over-indebtedness of consumers. Maltese insolvency law is regulated mainly through the provisions of the Commercial Code and the Companies Act, 1995 . The provisions in the Companies Act deal with insolvency of companies regulated by this Act, while those in the Commercial Code deal with bankruptcy of traders or of commercial partnerships.
