DANGEROUS SUBSTANCES ACT 2004 - SECT 217

Regulations may exempt people, plant or premises from Act

    (1)     A regulation may—

        (a)     exempt plant, premises or a person, from this Act; or

        (b)     authorise the work health and safety commissioner to exempt plant, premises or a person, from this Act.

Note     A reference to an Act includes a reference to a provision of an Act (see Legislation Act

, s 7 (3)).

    (2)     An exemption given by a regulation mentioned in subsection (1) may be conditional.

    (3)     A regulation may make provision in relation to the failure to comply with a condition of an exemption (including an exemption under this section).

    (4)     A regulation may provide for the work health and safety commissioner to—

        (a)     suspend the operation of a regulation mentioned in subsection (1) (a) in a certain way or in certain circumstances; or

        (b)     suspend the operation of an exemption given by the work health and safety commissioner to plant or premises, or a person, in a certain way or in certain circumstances.
