PROFESSIONAL ENGINEERS ACT 2023 (NO. 8 OF 2023) - SECT 74

Definitions—div 10.1

    (1)     In this division:

"law of another jurisdiction" means a law of the Commonwealth, a State or the Northern Territory.

"non-territory agency" means an agency of the Commonwealth, a State or the Northern Territory that exercises functions substantively corresponding to those exercised by a public safety agency.

"public safety agency" means any of the following:

        (a)     the registrar;

        (b)     the director-general responsible for this Act or an operational Act;

        (c)     an inspector appointed under an operational Act;

        (d)     the director-general responsible for the Emergencies Act 2004

;

        (e)     the commissioner and chief officers appointed under the Emergencies Act 2004

;

        (f)     an inspector appointed under the Emergencies Act 2004

;

        (g)     the director-general responsible for the Work Health and Safety Act 2011

;

        (h)     the commissioner appointed under the Work Health and Safety Act 2011

;

              (i)     an inspector appointed under the Work Health and Safety Act 2011

;

        (j)     an agency prescribed by regulation.

"public safety information" means information in relation to a situation that presents, or is likely to present, a risk of death or injury to a person, significant harm to the environment or significant damage to property, that is disclosed to, or obtained by, a public safety agency because the agency is, or has been, a public safety agency.

    (2)     In this section:

"operational Act" means any of the following:

        (a)     Building Act 2004

;

        (b)     Construction Occupations (Licensing) Act 2004

;

        (c)     Dangerous Substances Act 2004

;

        (d)     Electricity Safety Act 1971

;

        (e)     Gas Safety Act 2000

;

        (f)     Planning and Development Act 2007

;

        (g)     Unit Titles Act 2001

;

        (h)     Utilities Act 2000

;

              (i)     Water and Sewerage Act 2000
