PUBLIC POOLS ACT 2015 (NO. 7 OF 2015) - SECT 11

Exemption of pool facility or person from Act

    (1)     The Minister may exempt a pool facility or person from this Act.

Note 1     A reference to an Act includes a reference to a provision of an Act (see Legislation Act

, s 7 (3)).

Note 2     A reference to an Act includes a reference to the statutory instruments made or in force under the Act, including any regulation (see Legislation Act

, s 104).

Note 3     Power to make a statutory instrument (including exemptions) includes power to make different provision in relation to different matters or different classes of matters, and to make an instrument that applies differently by reference to stated exceptions or factors (see Legislation Act

, s 48).

    (2)     In deciding whether to exempt a pool facility or person from this Act, the Minister must take into account any criteria prescribed by regulation.

    (3)     An exemption may be conditional.

    (4)     An exemption has no effect––

        (a)     to the extent that it is inconsistent with a regulation; or

        (b)     during any period in which a condition of the exemption is not complied with.

    (5)     An exemption is a disallowable instrument.

Note     A disallowable instrument must be notified, and presented to the Legislative Assembly, under the Legislation Act
