Classification of Publications (Amendment) Ordinance (No. 2) 1994

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Ordinance under the Seat of Government (Administration) Act 1910.

An Ordinance to amend the Classification of Publications Ordinance 1983
1. This Ordinance may be cited as the Classification of Publications (Amendment) Ordinance (No. 2) 1994.1
2. (1) Section 1 and this section commence on the day on which this Ordinance is notified in the Gazette.
(2) The remaining provisions commence on a day fixed by the Minister by notice in the Gazette.
3. In this Ordinance, “Principal Ordinance” means the Classification of Publications Ordinance 1983.2
4. Section 25A of the Principal Ordinance is amended—
(a) by omitting subsection (3) and substituting the following subsection:
“(3) Subject to this section, where the Censorship Board decides that a computer game is unsuitable for viewing or playing by a minor, the Board shall approve the classification of the computer game as an ‘R (18+)’ computer game.”; and
(b) by omitting from paragraph (4) (a) “or” (last occurring) and substituting “and”.
5. Section 34 of the Principal Ordinance is amended—
(a) by inserting after subsection (2) the following subsection:
“(2A) A prescribed authority shall apply the classification guidelines in deciding what classification (if any) should be given to a publication other than advertising matter in relation to a film or computer game.”.
(b) by adding at the end of paragraph (4) (a) “and”;
(c) by omitting from paragraph (4) (b) “and”;
(d) by omitting paragraph (4) (c); and
(e) by omitting from subsection (4A) “paragraph (4) (c)” and substituting “subsection (2A)”.
