Evidence (Amendment) Ordinance 1985

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Ordinance under the Seat of Government (Administration) Act 1910.

An Ordinance to amend the Evidence Ordinance 1971

Short title

1. This Ordinance may be cited as the Evidence (Amendment) Ordinance 1985.1

Depositions of persons dangerously ill

2. Section 72 of the Evidence Ordinance 19712 is amended—

(a) by omitting from sub-section (3) “Deputy Crown Solicitor” and substituting “Director of Public Prosecutions or a person authorized by the Director of Public Prosecutions”; and

(b) by omitting from sub-section (4) “Deputy Crown Solicitor, he or a person authorized by him, is entitled, to be present personally or by his counsel or solicitor” and substituting “Director of Public Prosecutions or a person authorized by the Director of Public Prosecutions, the Director of Public Prosecutions, that person or a person representing the Director of Public Prosecutions is entitled to be present”.
