House of Assembly (Amendment) Ordinance 1985

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Ordinance under the Seat of Government (Administration) Act 1910.

An Ordinance to amend the House of Assembly Ordinance 1936

Short title

1. This Ordinance may be cited as the House of Assembly (Amendment) Ordinance 1985.¹

2. After section 4 of the House of Assembly Ordinance 1936² the following sections are inserted:

Extension of term of office of certain members

“4A. Notwithstanding sub-section 4 (3), the term of office of a person who, on 21 June 1985, is, or is to be deemed to be, a member of the Assembly is, by force of this section, extended and, subject to section 6, the person shall continue to hold office as a member of the Assembly until—

(a) if a direction for an election of members of the Assembly is given under the House of Assembly (Election) Regulations and the date appointed for the polling at the election is a date earlier than 30 June 1986—the expiration of the day on which the polling is conducted; or

(b) in any other case—the expiration of 30 June 1986.

Vacancy unfilled at 21 June 1985

“4B. Where, on 21 June 1985, a member of the Assembly has ceased to hold office and no person has been appointed to the vacant office, section 6 applies as if the term of office of the member had been a term ending at the time at which the term of office of a person referred to in section 4A ends.”.
