Remuneration (Repeal) Ordinance 1989

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Ordinance under the Seat of Government (Administration) Act 1910.

An Ordinance to repeal the Remuneration Ordinance 1976

Short title

1. This Ordinance may be cited as the Remuneration (Repeal) Ordinance 1989.1

Repeal

2. The following Ordinances are repealed:

Remuneration Ordinance 1976

Remuneration (Amendment) Ordinance 1978

Remuneration (Amendment) Ordinance (No. 2) 1978

Remuneration (Amendment) Ordinance 1980

Remuneration (Amendment) Ordinance (No. 2) 1980

Remuneration (Amendment) Ordinance 1982

Remuneration (Amendment) Ordinance 1983

Remuneration (Amendment) Ordinance 1984

Remuneration (Amendment) Ordinance 1986

Remuneration (Amendment) Ordinance 1988.

Transitional

3. (1) Notwithstanding the repeals effected by section 2, a person who is, or was, at any time during the defined period—

(a) the chairman; or

(b) a member;

within the meaning of the repealed Ordinance, of a body that was, at any time before the date of commencement of the Remuneration (Miscellaneous Amendments) Ordinance 1989, a prescribed authority within he meaning of the repealed Ordinance is entitled to be paid the defined amount.

(2) In this section—

“commencement date” means the date of commencement of this Ordinance;
“defined amount” means—

(a) in relation to the period commencing on 2 December 1987 and ending at the expiration of the day immediately preceding the commencement date—the difference between—

(i) the amount of remuneration and allowances to which the chairman or member would have been entitled if he or she had been a part-time holder of a public office within the meaning of the Remuneration Tribunals Act 1973, being an office determined to be a Category 2 office within the meaning of Determinations No. 18 of 1987 and No. 19 of 1988 of the Remuneration Tribunal; and

(ii) the amount of remuneration and allowances to which the chairman or member was entitled under the repealed Ordinance; and

(b) in relation to the period, if any, commencing on the commencement date and ending at the expiration of the day immediately preceding the defined date—the amount referred to in subparagraph (a) (i);

“defined date” means the date on which—

(a) the first determination of the Remuneration Tribunal relating to the remuneration and allowances to be paid to the chairman or member comes into effect;

(b) regulations under the Ordinance creating the prescribed authority prescribing the remuneration and allowances to be paid to the chairman or member come into effect; or

(c) the office of the chairman or member ceases to exist;

whichever occurs first;

“defined period” means the period commencing on 2 December 1987 and ending at the expiration of the day immediately preceding the defined date;
“repealed Ordinance” means the Remuneration Ordinance 1976 as in force immediately before the commencement date.

(3) For the purposes of this section, a Land Commissioner appointed under the Land Valuation Ordinance 1936 who holds office during the defined period shall be taken to be the chairman, within the meaning of the repealed Ordinance, of a body referred to in subsection (1).
