Real Property (Amendment) Ordinance (No. 3) 1986

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Ordinance under the Seat of Government (Administration) Act 1910.

An Ordinance to amend the Real Property Ordinance 1925

Short title

1. This Ordinance may be cited as the Real Property (Amendment) Ordinance (No. 3) 1986.1

Commencement

2. This Ordinance shall come into operation on such date as is fixed by the Minister of State for Territories by notice in the Gazette.

Principal Ordinance

3. In this Ordinance, “Principal Ordinance” means the Real Property Ordinance 1925.2

Conditions for registration

4. Section 51 of the Principal Ordinance is amended—

(a) by omitting from paragraph (2) (a) “or” (last occurring);

(b) by inserting after paragraph (2) (b) the following word and paragraph:

“; or (ba) an instrument executed on or after the date of commencement of the Real Property (Amendment) Ordinance (No. 3) 1986, being an instrument included in a class of instruments specified in item 6A of Schedule 1 to the Australian Capital Territory Stamp Duty Act 1969,”;

(c) by adding at the end of paragraph (2) (d) “or”;

(d) by omitting from paragraph (2) (e) “or”; and

(e) by omitting paragraph (2) (f).

Registration of Crown leases

5. Section 70 of the Principal Ordinance is amended—

(a) by omitting all the words from and including “exceeding” to and including “Ordinance” and substituting “of not less than 12 months granted by or in the name of the Commonwealth”; and

(b) by adding at the end the following sub-section:

“(2) The Registrar may register in the Register Book a Crown lease for a term of less than 12 months, being a Crown lease granted by or in the name of the Commonwealth after the date of commencement of the Real Property (Amendment) Ordinance (No. 3) 1986, by binding one copy in the Register Book and shall mark on both copies the volume and folium as appearing in the Register.”.
