This legislation has been repealed.
(1) The Magistrates Court, on proof to its satisfaction that section 12 (1) applies in relation to a prisoner, shall by order in writing direct the gaoler of the prison where the prisoner is being held to bring the prisoner before the court at a specified place, on a specified date and at a specified time, for determination as to whether an order of transfer should be issued.
(2) Notice of an order under subsection (1) shall be served on the Attorney-General and on the prisoner to whom the order relates.
(3) At a hearing pursuant to an order under subsection (1)—
(a) the prisoner is entitled to be represented by a legal practitioner; and
(b) the Attorney-General is entitled to appear or to be represented.
