MAGISTRATES COURT (CIVIL JURISDICTION) RULES 2004 (REPEALED) - REG 126

General power of amendment

    (1)     The court may, at any stage of proceedings, on application by a party or of its own motion, order that any document filed in the proceedings be amended, or give leave to any party to amend any document filed by him or her in the proceedings, in the way the court thinks just.

    (2)     All necessary amendments shall be made for the purpose of determining the real questions raised by or otherwise depending on the proceedings, of correcting any defect or error in the proceedings or of avoiding multiplicity of proceedings.

    (3)     If, in a document filed in proceedings, there has been a mistake in the name of a party to proceedings, subsection (1) applies in relation to the person intended to be made a party as if he or she were a party.

    (4)     This section does not apply in relation to the amendment of a judgment, order or certificate.
