MAGISTRATES COURT (CIVIL JURISDICTION) RULES 2004 (REPEALED) - REG 141

Dismissal for want of prosecution

    (1)     If—

        (a)     the plaintiff in proceedings does not, within a reasonable time, take any step necessary to have the proceedings heard; or

        (b)     the plaintiff in proceedings unreasonably takes any step to avoid the proceedings being heard;

the court may, on the application of the defendant, order, on the terms it thinks just, that the proceedings be dismissed for want of prosecution or may make such other order as it thinks just.

    (2)     If proceedings are dismissed under subsection (1), section 69 and section 70 apply as if those proceedings had been discontinued under part 9.
