MAGISTRATES COURT (CIVIL JURISDICTION) RULES 2004 (REPEALED) - REG 144

Common liability

    (1)     If, in proceedings, relief is claimed against a defendant who is jointly liable with some other person and also severally liable, that other person need not be made a defendant in the proceedings.

    (2)     If persons may be jointly, but not severally, liable and relief is claimed against some but not all of those persons in proceedings, the court may stay the proceedings until the other persons so liable are joined as defendants.
