MAGISTRATES COURT (CIVIL JURISDICTION) RULES 2004 (REPEALED) - REG 274

Contents of bills of costs

    (1)     A bill of costs prepared by a party whose costs in proceedings are to be taxed shall contain, in respect of those costs—

        (a)     a detailed statement of the work done by the solicitor for the party, or an employee or agent of that solicitor; and

        (b)     the date when each item of work was done; and

        (c)     the number of the item in the schedule on which it is intended to rely in claiming an amount in respect of each item of costs; and

        (d)     a detailed statement of the disbursements made; and

        (e)     the date when each disbursement was made; and

        (f)     the costs claimed for each item of work done or disbursement made.

    (2)     If any item of work specified in a bill of costs was done by a registrar or other employee of a solicitor and that fact is relevant to the amount of costs allowable for that work, a statement of that fact shall be included in the bill.

    (3)     If an item of work is done once in respect of 2 or more proceedings, the item may be included in a bill of costs filed in relation to any of those proceedings.

    (4)     If an item (other than an attendance in court by a solicitor or barrister) referred to in subsection (3) is allowed on a taxation of costs in proceedings, that item shall be allowed at the proportion of the appropriate amount for that item that the registrar thinks fit.

    (5)     The registrar may, if he or she thinks fit, proceed with the taxation of a bill of costs in proceedings notwithstanding that the bill does not comply with this section.

    (6)     The court or the registrar may, on the terms that it or he or she thinks fit, give leave for the amendment of a bill of costs filed in proceedings.
