The Parliament of Australia enacts:

1 Short title

This Act is the
Aged Care Legislation Amendment (Financial

Transparency) Act 2020
.

2 Commencement
8
(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10
column 2 of the table. Any other statement in column 2 has effect
11
according to its terms.

1 After section 9-2

Insert:

9-2A Obligation to provide Commissioner a financial transparency
6
report
7
(1) As soon as practicable within 6 months after the end of a financial
8
year, an approved provider must provide the
*
Quality and Safety
9
Commissioner with a written report for each facility operated by
10
the provider that provided residential care in the financial year.
11
(2) The
*
financial transparency report must include the following
12
information:
13
(a) the total number of residents at the facility;
14
(b) the total income received by the provider from the facility;
15
(c) the sources of that income which includes the following:
16
(i) subsidies;
17
(ii) standard resident contributions;
18
(iii) other sources of income specified by the provider;
19
(d) the total amount spent in the financial year;
20
(e) the total cost of direct and indirect care expenditure which
21
includes the aggregated cost of the following:
22
(i) food and food supplements;
23
(ii) medical products;
24
(iii) continence aids;
25
(f) the total cost of accommodation;
26
(g) the total cost of salaries and wages for all staff members by
27
category;
28
(h) the total cost of staff member training;
29
(i) the total amount of other operational expenditure itemised by
30
category;
31
(j) the total amount of non-operational costs;
32
(k) any amount paid to a related body corporate within the

meaning of section 50 of the
Corporations Act 2011

Note:
Approved providers have a responsibility under Part 4.3 to comply
2
with this obligation. Failure to comply with a responsibility can result
3
in a sanction being imposed under Part 7B of the *Quality and Safety
4
Commission Act. The financial transparency report provided under
5
this section is made publicly available (see section 96-11).

(3) For the purposes of paragraph (2)(g), the categories of staff
7
member are the following:
8
(a) registered nurses;
9
(b) enrolled nurses;
10
(c) personal care attendants;
11
(d) allied health staff;
12
(e) administrative staff;
13
(f) facility management;
14
(g) external consultants;
15
(h) other staff members.

Note 1:
The category of other staff members should be further broken down
17
into appropriate categories.

Note 2:
The information in the financial transparency report on the total cost
19
of salaries and wages for all staff members by category should be
20
broken down, for each category, by temporary, permanent ongoing
21
and agency staff.

(4) In this section:

staff member
of an approved provider has the same meaning as in
24
section 63-1AA.

(1C) If an approved provider (within the meaning of the
Aged Care Act
7
1997
) received more than $10 million in funding from the
8
Commonwealth in a financial year, the financial report for that
9
financial year must comply with the Tier 1 requirements of the
10
accounting standards.

5 Application of amendments
12
The amendments made by the
Aged Care Legislation Amendment
13
(Financial Transparency) Act 2020
apply in relation to a financial year
14
which begins on or after the day this Act commences.
