The Parliament of Australia enacts:

1 Short title
4
This Act is the Air Services Amendment Act 2018.
5
2 Commencement
6
(1) Each provision of this Act specified in column 1 of the table
7
commences, or is taken to have commenced, in accordance with
8
column 2 of the table. Any other statement in column 2 has effect
9
according to its terms.

10 AA must consult and cooperate
16
(1) In the performance of its functions and the exercise of its powers,
17
AA must, where appropriate, consult with government,
18
commercial, industrial, consumer, aircraft noise, community and
19
other relevant bodies and organisations (including ICAO and
20
bodies representing the aviation industry).
21
(2) During consultations, AA must advise other parties of how they
22
can make a complaint about AA's conduct, if they so wish,
23
including to the Aircraft Noise Ombudsman.
24
(3) AA must establish community consultation groups that represent
25
communities affected by aircraft operations (whether those
26
operations involve existing, new, or changing flight paths),
27
including:
28
(a) communities directly impacted by take-off and landing of
29
aircraft; and

(b) communities subjected to noise, including new or

intensifying noise, from air traffic flyover impact.
2
(4) AA must consult relevant community consultation groups about all
3
significant changes proposed to existing flight plan routes and all
4
new flight plan routes.
5
(5) If detrimental impacts are identified through consultation with
6
community consultation groups, AA must take such steps as it
7
considers appropriate to minimise those impacts.
8
(6) AA must publish on its website:
9
(a) details about when its consultations with community
10
consultation groups are to occur and the nature of the
11
proposed consultations; and
12
(b) details about the results of those consultations, including
13
details about any steps taken by AA.

10A Consulting with communities
15
Where AA has decided to propose changes in the management of
16
flight paths or airspace which would have, or be likely to have, any
17
impact on the human and natural environment, community amenity
18
or residential areas, AA must:
19
(a) arrange for consultations on the proposal under section 10;
20
and
21
(b) advise the Minister responsible for the Environment
22
Protection and Biodiversity Conservation Act 1999 of the
23
consultations; and
24
(c) request that Minister to appoint a Community Aviation
25
Advocate to represent the affected parts of the community
26
during the consultations.

10B Melbourne flightpaths
28
(1) As soon as practicable after the commencement of this section, AA
29
must:
30
(a) prepare a plan for the management of flight paths and air
31
space within 5 kilometres of central Melbourne; and

(b) arrange for consultations on the plan under section 10, and
1
take the steps mentioned in paragraphs 10A(b) and (c) in
2
relation to those consultations; and
3
(c) make any changes to the plan that AA considers appropriate
4
as a result of consultation; and
5
(d) give effect to the resulting plan.
6
(2) A plan proposed under subsection (1) must:
7
(a) prohibit helicopters and fixed wing aircraft from flying at less
8
than 2,000 metres above sea level over residential areas; and
9
(b) contain exemptions for the following:
10
(i) emergency services aircraft;
11
(ii) defence aircraft;
12
(iii) aircraft flying to or from a hospital;
13
(iv) other aircraft that it is in the public interest to exempt.

10C Review of flight paths created or changed on or after 1 January
15
2012
16
(1) A person may request AA to review a new flight path route, or a
17
change to an existing flight path route, made on or after 1 January
18
2012 as a result of AA's management of flight paths if:
19
(a) the person is directly impacted by take-off and landing of
20
aircraft because of the flight path; or
21
(b) the person is subjected to high intensity air traffic from
22
flyover impact because of the flight path.
23
(2) If requested to do so under subsection (1), AA must:
24
(a) review the flight path route; and
25
(b) arrange for consultations under section 10 for the purposes of
26
the review, and take the steps mentioned in paragraphs
27
10A(b) and (c) in relation to those consultations; and
28
(c) take such steps as AA considers appropriate as a result of the
29
review.
30
(3) In conducting the review, AA must consider whether the new flight
31
path, or the change to the existing flight path, has had, or is likely
32
to have, any impact on the human and natural environment,
33
community amenity or residential areas.

There is to be an Aircraft Noise Ombudsman.

73B Functions of the Aircraft Noise Ombudsman
20
The functions of the Aircraft Noise Ombudsman are the following:
21
(a) reviewing the handling of complaints or enquiries made to
22
AA, CASA or the Department of Defence about aircraft
23
noise, whether on application by a complainant, at the
24
Aircraft Noise Ombudsman's own initiative or at the request
25
of AA, the Department of Defence or the Minister;
26
(b) reporting to AA, CASA or the Department of Defence (as the
27
case requires), and the Minister (as the Aircraft Noise
28

Ombudsman considers appropriate), about reviews
1
undertaken as mentioned in paragraph (a);
2
(c) monitoring and reporting on the effectiveness of community
3
consultation processes about aircraft noise that are
4
undertaken by AA, CASA or the Department of Defence;
5
(d) monitoring and reporting on the effectiveness of the
6
presentation and distribution of information about aircraft
7
noise;
8
(e) reviewing other matters relating to the management of
9
aircraft noise by AA or the Department of Defence, on
10
request by AA or the Department of Defence (as the case
11
requires);
12
(f) making recommendations to the Minister, AA, CASA or the
13
Department of Defence for improvements in the management
14
of aircraft noise;
15
(g) any other functions the Minister considers appropriate.

73C General policy guidelines
17
In performing the Aircraft Noise Ombudsman's functions, the
18
Aircraft Noise Ombudsman must:
19
(a) perform the functions in the most convenient and effective
20
way possible; and
21
(b) avoid duplicating the operations of any other agency of the
22
Commonwealth, a State or a Territory that performs a
23
function that wholly or partly overlaps with a function of the
24
Aircraft Noise Ombudsman; and
25
(c) work cooperatively, as far as is possible, with other agencies
26
of the Commonwealth, the States and the Territories; and
27
(d) comply with all other laws of the Commonwealth.

73D Flexibility and range of working methods in performance of
29
functions
30
(1) The Aircraft Noise Ombudsman is not required to act in a formal
31
manner in the performance of the Aircraft Noise Ombudsman's
32
functions, unless otherwise required to do so under this Act, or any
33
other Act or legislative instrument.

(2) In the performance of the Aircraft Noise Ombudsman's functions,
1
the Aircraft Noise Ombudsman may:
2
(a) inform himself or herself on any matter in any way the
3
Aircraft Noise Ombudsman thinks fit; and
4
(b) consult with anyone the Aircraft Noise Ombudsman thinks
5
fit; and
6
(c) receive written or oral information or submissions.

73E Aircraft Noise Ombudsman's powers
8
The Aircraft Noise Ombudsman has power to do all things
9
necessary or convenient to be done for or in connection with the
10
performance of the Aircraft Noise Ombudsman's functions.
11
Note:
The Secretary may enter into contracts and other arrangements on
12
behalf of the Commonwealth to assist the Aircraft Noise Ombudsman
13
in performing the Aircraft Noise Ombudsman's functions. See
14
section 23 of the Public Governance, Performance and Accountability
15
Act 2013.

73F Delegation by the Aircraft Noise Ombudsman
17
(1) The Aircraft Noise Ombudsman may, by written instrument,
18
delegate the functions and powers of the Aircraft Noise
19
Ombudsman to:
20
(a) an SES employee, or acting SES employee, in the
21
Department; or
22
(b) an APS employee who holds or performs the duties of an
23
Executive Level 1 or 2 position, or an equivalent position, in
24
the Department.
25
(2) In exercising powers or performing functions under a delegation,
26
the delegate must comply with any written directions by the
27
Aircraft Noise Ombudsman.

73G Directions from the Minister
29
(1) The Minister may, by legislative instrument, give written directions
30
to the Aircraft Noise Ombudsman about the performance of the
31
Aircraft Noise Ombudsman's functions.

Note 1:
Section 42 (disallowance) of the Legislation Act 2003 does not apply
33
to the direction: see regulations made for the purposes of
34
paragraph 44(2)(b) of that Act.

Note 2:
Part 4 of Chapter 3 (sunsetting) of the Legislation Act 2003 does not

apply to the direction: see regulations made for the purposes of

(2) The direction must be of a general nature only.

(3) The Aircraft Noise Ombudsman must comply with the direction.

73H Minister may require reports
6
(1) The Minister may, in writing, direct the Aircraft Noise
7
Ombudsman to give the Minister specified reports relating to the
8
Aircraft Noise Ombudsman's functions.
9
(2) The Aircraft Noise Ombudsman must comply with the direction.
10
(3) The direction, or the report (if made in writing), is not a legislative
11
instrument.

73I Aircraft Noise Ombudsman is an official for the purposes of the
13
finance law
14
The Aircraft Noise Ombudsman is an official of the Department
15
for the purposes of the finance law (as defined for the purposes of
16
the Public Governance, Performance and Accountability Act
17
2013).
18
Note:
The Aircraft Noise Ombudsman's responsibilities as an official under
19
the Public Governance, Performance and Accountability Act 2013
20
include duties in relation to exercising due care and diligence, acting
21
in good faith and for a proper purpose, not improperly using
22
information or position and disclosing material interests (see
23
Division 3 of Part 2-2 of that Act).

73J Annual report
25
The regulations may prescribe additional matters to be included in
26
the annual report prepared by the Department and given to the
27
Minister under section 46 of the Public Governance, Performance
28
and Accountability Act 2013 for a period.

Division 2--Appointment and terms and conditions of the

Aircraft Noise Ombudsman

73K Appointment
3
(1) The Aircraft Noise Ombudsman is to be appointed by the
4
Governor-General by written instrument.
5
(2) Before the Governor-General appoints a person as the Aircraft
6
Noise Ombudsman, the Minister must be satisfied that the person:
7
(a) has suitable qualifications or experience; and
8
(b) is of good character.
9
(3) The Aircraft Noise Ombudsman holds office on a full-time basis.
10
(4) The Aircraft Noise Ombudsman holds office for the period
11
specified in the instrument of appointment. The period must not
12
exceed 5 years.
13
Note:
The Aircraft Noise Ombudsman may be reappointed: see
14
section 33AA of the Acts Interpretation Act 1901.

73L Terms and conditions of appointment
16
The regulations may make provision for the following:
17
(a) the appointment of the Aircraft Noise Ombudsman by the
18
Minister;
19
(b) the remuneration, and other terms and conditions of
20
appointment, of the Aircraft Noise Ombudsman;
21
(c) the appointment of a person to act as the Aircraft Noise
22
Ombudsman in particular circumstances;
23
(d) the Aircraft Noise Ombudsman's resignation and the
24
termination of the Aircraft Noise Ombudsman's appointment
25
by the Minister for reasons prescribed in the regulations;
26
(e) immunity of the Aircraft Noise Ombudsman from civil
27
proceedings.

Division 3--Persons assisting the Aircraft Noise

Ombudsman

73M Staff
3
The staff necessary to assist the Aircraft Noise Ombudsman are to
4
be persons engaged under the Public Service Act 1999 and made
5
available for the purpose by the Secretary of the Department.
6
73N Consultants
7
The Secretary may, on behalf of the Commonwealth, engage
8
consultants to assist in the performance of the Aircraft Noise
9
Ombudsman's functions.

Division 3A--Complaints
11
73NA Complaints
12
The regulations may make provision for the following:
13
(a) the circumstances in which the Aircraft Noise Ombudsman
14
may refuse to review or investigate a complaint or any other
15
matter;
16
(b) the circumstances in which the Aircraft Noise Ombudsman
17
may transfer a complaint to another person or body,
18
including AA, CASA or the Department of Defence.
19
Division 4--Research and inquiries on Aircraft Noise
20
Ombudsman's own initiative
21
73O Research and inquiries
22
The Aircraft Noise Ombudsman may, on his or her own initiative,
23
conduct research or make inquiries into the following:
24
(a) the effect of aircraft noise on communities;
25
(b) ways in which legislation, policies or practices might be
26
improved to assist communities affected by aircraft noise.

73P Reports to the Minister
1
(1) The Aircraft Noise Ombudsman must give the Minister a report in
2
relation to each quarter that:
3
(a) outlines the research conducted and inquiries made during
4
the quarter; and
5
(b) if the Aircraft Noise Ombudsman reasonably believes that
6
legislation, policies or practices have had, are having or are
7
reasonably likely to have an adverse effect on communities
8
affected by aircraft noise--outlines that fact and the reasons
9
for the Aircraft Noise Ombudsman's conclusion.
10
(2) The report must be given within 20 business days after the end of
11
the quarter.
12
(3) The Aircraft Noise Ombudsman may at any time give the Minister
13
a report in relation to research conducted or inquiries made into
14
any legislation, policies or practices.
15
(4) A report given to the Minister under this section may include
16
recommendations by the Aircraft Noise Ombudsman in relation to
17
any matter included in the report.

73Q Minister may publish Aircraft Noise Ombudsman's report
19
The Minister may publish a report, or any part of a report, given to
20
the Minister under section 73P in any way he or she thinks fit.
21
73R Information and documents
22
The regulations may make provision for the Aircraft Noise
23
Ombudsman to require the production of information and
24
documents related to the Ombudsman's functions.
25
73RA Limitation on powers
26
Nothing in this Division allows a power to be exercised to the
27
extent that it would impair the capacity of a State to exercise its
28
constitutional powers.

Division 5--Minister may refer matter to Aircraft Noise
1
Ombudsman for inquiry
2
73S Minister may refer a matter for inquiry
3
(1) The Minister may refer the following matters to the Aircraft Noise
4
Ombudsman for inquiry:
5
(a) the effect of legislation, policies or practices on communities
6
affected by aircraft noise;
7
(b) ways in which legislation, policies or practices might be
8
improved to assist communities affected by aircraft noise.
9
(2) In referring a matter to the Aircraft Noise Ombudsman for inquiry,
10
the Minister may, for the purpose of ensuring that the inquiry is
11
conducted in the manner appropriate to that inquiry, do any or all
12
of the following:
13
(a) require the Aircraft Noise Ombudsman to:
14
(i) hold hearings for the purposes of the inquiry; and
15
(ii) make a draft report available to the public during an
16
inquiry; and
17
(iii) make recommendations in relation to the matter;
18
(b) specify a period within which the Aircraft Noise Ombudsman
19
must submit his or her report on the inquiry to the Minister.
20
(3) The Aircraft Noise Ombudsman must comply with a requirement
21
imposed by the Minister under subsection (2).

73T Notice of inquiry
23
As soon as practicable after the Aircraft Noise Ombudsman
24
receives a reference to hold an inquiry, the Ombudsman must give
25
reasonable notice in each State and Territory, by advertisement
26
published on a website, of the intention to hold the inquiry.
27
73U Aircraft Noise Ombudsman must prepare a report on the
28
inquiry
29
If the Minister refers a matter to the Aircraft Noise Ombudsman
30
for inquiry, the Ombudsman must make a written report to the
31
Minister on the inquiry, unless the Minister withdraws the
32
reference to the Ombudsman.

73V Report of inquiry to be tabled
1
(1) The Minister must cause a copy of the Aircraft Noise
2
Ombudsman's report on an inquiry to be tabled in each House of
3
the Parliament:
4
(a) within 25 sitting days of that House after the day on which
5
the Minister receives it; or
6
(b) if the Ombudsman recommends that the tabling of the report,
7
or part of the report, be delayed for a specified period--
8
within 25 sitting days of that House after the end of that
9
period.
10
(2) If the publication of information or an opinion in the report would
11
be likely to adversely affect the interests of any person, the
12
Minister must, before tabling the report, direct the Aircraft Noise
13
Ombudsman:
14
(a) to notify the person that the information or opinion is
15
contained in the report; and
16
(b) to give the person a reasonable period (not exceeding 30
17
days) to make representations, either orally or in writing, in
18
relation to the information or opinion, and its publication.
19
(3) Before tabling the report on an inquiry, the Minister:
20
(a) may delete any information or opinion from the report if:
21
(i) the information or opinion would be likely to adversely
22
affect the interests of any person; and
23
(ii) the Minister reasonably believes that it is in the public
24
interest to delete the information or opinion; and
25
(b) must delete from the report any confidential information.
26
(4) In making a decision under subparagraph (3)(a)(ii), the Minister
27
must take into account any representations made by the person in
28
response to a notification under subsection (2).
29
(5) A direction under subsection (2) (if made in writing) is not a
30
legislative instrument.

73W Hearings
32
The regulations may make provision for the following:
33
(a) notice of, and procedure at, hearings of an inquiry;
34

(b) notices to persons to provide information or documents
1
relevant to an inquiry;
2
(c) summons to attending hearings;
3
(d) allowances to witnesses for appearing at hearings;
4
(e) any other matters relevant to the conduct of hearings, the
5
production of evidence at hearings or the appearance of
6
witnesses at hearings.

Division 6--Providing advice to the Minister
8
73X Minister may refer a matter for advice
9
(1) The Minister may refer the following matters to the Aircraft Noise
10
Ombudsman for advice:
11
(a) the effect of legislation, policies or practices on communities
12
affected by aircraft noise;
13
(b) ways in which legislation, policies or practices might be
14
improved to assist communities affected by aircraft noise.
15
(2) If the Minister refers a matter to the Aircraft Noise Ombudsman
16
for advice, the Minister may specify any or all of the following:
17
(a) that the advice is to be in writing;
18
(b) a period within which the advice is to be given;
19
(c) any matter to which the Aircraft Noise Ombudsman is to
20
have regard in giving the advice.
21
(3) The Aircraft Noise Ombudsman must comply with a requirement
22
imposed by the Minister under subsection (2).
23
(4) If the Minister refers a matter to the Aircraft Noise Ombudsman
24
for advice, the Aircraft Noise Ombudsman may also advise the
25
Minister on any matters the Aircraft Noise Ombudsman considers
26
relevant to the matter.
27
73Y Minister may publish Aircraft Noise Ombudsman's advice
28
(1) The Minister may publish advice given by the Aircraft Noise
29
Ombudsman under section 73X in any way he or she thinks fit.
30
(2) If the publication of information or an opinion in the advice would
31
be likely to adversely affect the interests of any person, the

Minister must, before publishing the advice, direct the Aircraft
1
Noise Ombudsman:
2
(a) to notify the person that the information or opinion is
3
contained in the advice; and
4

relation to the information or opinion, and its publication.

The regulations may make provision for the following:

(a) the powers of the Aircraft Noise Ombudsman to obtain
23
information and documents from AA, CASA or the
24
Department of Defence for the purpose of performing the
25
Aircraft Noise Ombudsman's functions;
26
(b) the circumstances in which information or documents given
27
to the Aircraft Noise Ombudsman may be disclosed;
28
(c) the powers and functions of the Ombudsman in relation to
29
responding to requests from persons or communities affected
30
by aircraft noise for assistance;
31
(d) the review of decisions by the Aircraft Noise Ombudsman.

complaints between AA and the Aircraft Noise Ombudsman.

Services Act 1995 that Airservices Australia is proposing changes

in the management of aircraft noise or airspace which would have,

or would be likely to have, a significant impact on the human or
18
natural environment, community amenity or residential areas, or
19
forms this opinion through other means, the Minister must appoint
20
a Community Aviation Advocate in relation to these changes.

(2) The role of the Community Aviation Advocate is to assist, inform
22
and advocate on behalf of the parts of the community likely to be
23
affected by the proposed changes in subsection (1).

(3) The Community Aviation Advocate must be independent of
25
aviation interests.
