1 Short title

This Act is the

.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

196A Persons on incoming aircraft or vessel may be subject to
7
requirements relating to diseases or pests
8
(1) This section applies for the purposes of preventing, or reducing the
9
risk of, a disease or pest that is considered to pose an unacceptable
10
level of biosecurity risk entering, or establishing itself or spreading
11
in, Australian territory or a part of Australian territory.
12
Note:
This Division does not apply in relation to invasive pests (see
13
subsection 25(2)).

(2) The Agriculture Minister may determine one or more requirements
15
for individuals who are entering Australian territory at a landing
16
place or port in accordance with Division 2 or 3 of Part 4 of this
17
Chapter.

Note:
An individual who fails to comply with a requirement may contravene
19
a civil penalty provision (see section 196C).
20
(3) The determination must specify the disease or pest referred to in
21
subsection (1).
22
(4) A determination made under subsection (2) is a legislative
23
instrument, but section 42 (disallowance) of the
Legislation Act
24
2003
does not apply to the instrument.
25
(5) A requirement must not be specified in a determination unless the
26
Agriculture Minister is satisfied that:
27
(a) the disease or pest poses an unacceptable level of biosecurity
28
risk; and
29
(b) the requirement is appropriate and adapted to prevent, or
30
reduce the risk of, the disease or pest entering, or establishing

itself or spreading in, Australian territory or a part of

Australian territory.

Where requirements apply
3
(6) The determination must specify where the requirements apply.
4
Kinds of requirements that may be specified
5
(7) Without limiting subsection (2), the determination may specify:
6
(a) requirements for all individuals, or classes of individuals; and
7
(b) requirements in relation to particular diseases or pests or
8
classes of diseases or pests; and
9
(c) general requirements in relation to
all specified diseases or
10
pests; and
11
(d) requirements relating to the manner in which an individual
12
must comply with a requirement.
13
(8) Without limiting subsection (2), the determination may specify one
14
or more of the following requirements:
15
(a) a requirement for an individual to provide a declaration or
16
evidence as to whether the individual has been exposed to
17
goods, conveyances, premises or other things specified in the
18
determination;
19
(b) a requirement for an individual to provide a declaration or
20
evidence as to where the individual has been before entering
21
Australian territory;
22
(c) a requirement for an individual to provide a declaration or
23
evidence as to whether the individual has undertaken
24
specified activities during a specified period before entering
25
Australian territory, and, if so, specified details about those
26
activities;
27
(d) a requirement for an individual to provide a declaration as to
28
the individual's intended destination or destinations in
29
Australian territory during a specified period after entering
30
Australian territory;
31
(e) a requirement for an individual to provide a declaration as to
32
the individual's intended work (whether paid or unpaid) or
33
occupation during a specified period
after entering Australian
34
territory;

(f) a requirement for an individual to be screened (whether by
1
requiring the individual to be screened by equipment, by
2
providing a declaration, or in any other way);
3
(g) a requirement for an individual to move to a place, at the
4
landing place or port, directed by a biosecurity officer
5
(whether the direction is in relation to the individual or a
6
class that includes the individual) for the purpose of a
7
biosecurity officer assessing the level of biosecurity risk
8
associated with either or both of the following:
9
(i) the individual;
10
(ii) any goods the individual is bringing with them into
11
Australian territory at the landing place or port.

Note 1:
A person may commit an offence or contravene a civil penalty
13
provision if the person provides false or misleading information or
14
documents (see sections 137.1 and 137.2 of the
Criminal Code
and
15
sections 532 and 533 of this Act).
16
Note 2:
This section is not subject to the privilege against self-incrimination
17
(see section 635).
18
Consultations before making determination
19
(9) Before making a determination, the Agriculture Minister must
20
consult with:
21
(a) the Director of Biosecurity; and
22
(b) the Director of Human Biosecurity; and
23
(c) the head (however described) of the State or Territory body
24
that is responsible for the administration of matters relating
25
to biosecurity in each State and Territory.
26
(10) A failure by the Agriculture Minister to comply with subsection (9)
27
does not affect the validity of the determination.
28
196B Varying and revoking requirements
29
(1) The Agriculture Minister must vary or revoke a determination in
30
force under section 196A in relation to a disease or pest if the
31
Agriculture Minister is satisfied that:
32
(a) the disease or pest no longer poses an unacceptable
33
biosecurity risk; or

(b) a requirement determined in relation to the disease or pest is
1
no longer appropriate and adapted to prevent, or reduce the
2
risk of, the disease or pest entering, or establishing itself or
3
spreading in, Australian territory or a part of Australian
4
territory.

(2) An instrument that varies or revokes a determination made under
6
section 196A is a legislative instrument, but section 42
7
(disallowance) of the
Legislation Act 2003
does not apply to the
8
instrument.

(3) This section does not limit the application of subsection 33(3) of
10
the
Acts Interpretation Act 1901
in relation to a determination in
11
force under section 196A.

196C Civil penalty for failing to comply with requirement

An individual to whom a requirement determined under

section 196A applies must comply with the requirement.

The Agriculture Minister may determine certain biosecurity
17
measures for the purposes of preventing a specified behaviour or
18
practice that causes, or contributes to, the entry into, or the
19
emergence, establishment or spread in, Australian territory or a
20
part of Australian territory of a specified disease (other than a
21
listed human disease), or pest, that is considered to pose an
22
unacceptable level of biosecurity risk.

Division 2--Preventative biosecurity measures

393B Determining preventative biosecurity measures
2
(1) This section applies for the purposes of preventing a behaviour or
3
practice that:
4
(a) may cause a disease (other than a listed human disease), or
5
pest, that is considered to pose an unacceptable level of
6
biosecurity risk to enter, or emerge, establish itself or spread
7
in, Australian territory or a part of Australian territory; or
8
(b) may contribute to a disease or pest in relation to which
9
paragraph (a) applies entering, or emerging, establishing
10
itself or spreading in, Australian territory or a part of
11
Australian territory.

Note:
For preventative biosecurity measures relating to listed human
13
diseases, see section 51.

(2) The Agriculture Minister may make a determination that specifies
15
any one or more of the following biosecurity measures to be taken
16
by specified classes of persons:
17
(a) banning or restricting a behaviour or practice;
18
(b) requiring a behaviour or practice;
19
(c) requiring a specified person to provide a specified report or
20
keep specified records;
21
(d) conducting specified tests on specified goods or specified
22
conveyances.

Note:
A person who fails to comply with a biosecurity measure may
24
contravene a civil penalty provision (see section 393C).
25
(3) The determination must specify the behaviour or practice, and the
26
disease or pest, referred to in subsection (1).
27
(4) A determination made under subsection (2) is a legislative
28
instrument, but section 42 (disallowance) of the

(5) A biosecurity measure must not be specified in a determination
31
unless the Agriculture Minister is satisfied that:

(a) the disease or pest poses an unacceptable level of biosecurity

territory or a part of Australian territory.

Period of determination
7
(6) A determination must specify the period during which it is in force,
8
which must not be more than 1 year.

Consultations before making determination
10
(7) Before making a determination, the Agriculture Minister must
11
consult with:
12
(a) the Director of Biosecurity; and
13
(b) the Director of Human Biosecurity; and
14
(c) the head (however described) of the State or Territory body
15
that is responsible for the administration of matters relating
16
to biosecurity in each State and Territory.

(8) A failure by the Agriculture Minister to comply with subsection (7)
18
does not affect the validity of the determination.

393C Civil penalty for failing to comply with a preventative

biosecurity measure

A person to whom a biosecurity measure specified in accordance
22
with subsection 393B(2) applies must comply with the biosecurity

(4) Subsection (1) does not apply if the person uses or discloses the

information in good faith:

(a) in the purported performance of functions or duties, or the

purported exercise of powers, under this Act; or

(b) in assisting another person in the purported performance of

(b) the potential for the disease to cause serious harm to human
11
health.

584 Disclosure for the purposes of a State or Territory managing
13
risks
14
(1) An entrusted person may disclose relevant information to a State or
15
Territory body if the disclosure is for the purpose of assisting the
16
State or Territory body to perform its functions or duties, or
17
exercise its powers, in relation to managing a risk covered by
18
subsection (2) for the State or Territory.
19
(2) The risk covered by this subsection for a State or Territory is:
20
(a) the likelihood of a disease or pest:
21
(i) entering the State or Territory or a part of the State or
22
Territory; or
23
(ii) emerging, establishing itself or spreading in the State or
24
Territory or a part of the State or Territory; and
25
(b) the potential for any of the following:
26
(i) the disease or pest to cause serious harm to human,
27
animal or plant health in that State or Territory;
28
(ii) the disease or pest to cause serious harm to the
29
environment in that State or Territory;
30
(iii) serious economic consequences in that State or
31
Territory associated with the entry, emergence,
32
establishment or spread of the disease or pest as
33
mentioned in paragraph (a).

585 Disclosure for the purposes of foreign governments etc.

managing risks
2
(1) An entrusted person may disclose relevant information to a foreign
3
government, an authority or agency of a foreign government or an
4
international body of an intergovernmental character, for the
5
purposes of:
6
(a) the government, authority, agency or body managing a risk
7
covered by subsection (2); or
8
(b) giving effect to Australia's international obligations.
9
(2) The risk covered by this subsection is:
10
(a) the likelihood of a disease or pest:
11
(i) entering a foreign country or a part of a foreign country;
12
or
13
(ii) emerging, establishing itself or spreading in a foreign
14
country or a part of a foreign country; and
15
(b) the potential for any of the following:
16
(i) the disease or pest to cause harm to human, animal or
17
plant health in that foreign country;
18
(ii) the disease or pest to cause harm to the environment in
19
that foreign country;
20
(iii) economic consequences in that foreign country
21
associated with the entry, emergence, establishment or
22
spread of the disease or pest as mentioned in
23
paragraph (a).

586 Use or disclosure for the purposes of certain Acts
25
An entrusted person may use or disclose relevant information if the
26
use or disclosure is for the purposes of the administration of this
27
Act or another Act that is administered by the Agriculture Minister
28
or the Health Minister.

587 Disclosure to a Commonwealth entity
30
An entrusted person may disclose relevant information to a
31
Commonwealth entity if the disclosure is
for the purposes of
32
assisting the entity to perform its functions or duties or exercise its
33
powers.

588 Disclosure to a court, tribunal etc.
1
(1) An entrusted person may disclose relevant information to a court
2
exercising federal jurisdiction.
3
(2) An entrusted person may disclose relevant information to:
4
(a) a court; or
5
(b) a tribunal, authority or person that has the power to require
6
the answering of questions or the production of documents;
7
for the purposes of the enforcement of a law of the Commonwealth
8
or to assist the court, tribunal, authority or person to make or
9
review an administrative decision that is required or authorised to
10
be made under a law of the Commonwealth.
11
589 Disclosure for the purposes of law enforcement
12
(1) An entrusted person may disclose relevant information to a body
13
mentioned in subsection (2) if:
14
(a) the entrusted person reasonably believes that disclosing the
15
information is necessary for:
16
(i) the enforcement of the criminal law; or
17
(ii) the enforcement of a law imposing a pecuniary penalty;
18
or
19
(iii) the protection of public revenue; and
20
(b) the functions of the body include that enforcement or
21
protection; and
22
(c) for a body mentioned in paragraph (2)(b) or (d)--the body
23
has undertaken not to use or further disclose the information
24
except in accordance with an agreement that:
25
(i) is in force between the Commonwealth and the State or
26
Territory; and
27
(ii) applies in relation to the information; and
28
(d) for a body mentioned in paragraph (2)(b) or (d)--the
29
entrusted person is satisfied that the information will be used
30
or further disclosed only in accordance with the agreement.
31
(2) The bodies are the following:
32
(a) a Commonwealth entity;
33
(b) a State or Territory body;

(c) the Australian Federal Police;

(d) the police force or police service of a State or Territory.

590 Use or disclosure for research, policy development or data
3
analysis
4
(1) An entrusted person may:
5
(a) use relevant information; or
6
(b) disclose relevant information to an entrusted person; or
7
(c) disclose relevant information to another person or body;
8
for the purposes of the person or body undertaking research, policy
9
development or data analysis to assist the Agriculture Department
10
or the Health Department with the administration of this Act.
11
(2) An entrusted person is not authorised under paragraph (1)(c) to
12
disclose relevant information to:
13
(a) another person who is not employed or engaged by the
14
Commonwealth or a body corporate that is established by a
15
law of the Commonwealth; or
16
(b) a body that is not a Commonwealth entity;
17
unless:
18
(c) the other person or body has undertaken not to use or further
19
disclose the information except in accordance with an
20
agreement that:
21
(i) is in force between the Commonwealth and that person
22
or body; and
23
(ii) applies in relation to the information; and
24
(d) the entrusted person is satisfied that the information will be
25
used or further disclosed only in accordance with the
26
agreement.
27
(3) An entrusted person is not authorised under paragraph (1)(c) to
28
disclose relevant information unless the entrusted person is
29
satisfied that:
30
(a) in the case of research, policy development or data analysis
31
that could not proceed if personal information were
32
de-identified before the relevant information is disclosed--
33
only the minimum amount of personal information necessary
34
to proceed is disclosed; or

(b) otherwise--all reasonable steps have been taken to

(a) using or disclosing the information is necessary to manage a

severe and immediate threat to human health, animal health,
17
plant health or the environment; and

(b) the threat has the potential to cause harm on a nationally
19
significant scale.

(1) A person may use relevant information if:

28 Application and saving provisions

(1)
The amendments of the
Biosecurity Act 2015
made by this Schedule

apply in relation to the use or disclosure of relevant information on or
16
after the commencement of this item, whether the relevant information
17
is obtained or generated before, on or after that commencement.

(2)
Despite the amendments of the
Biosecurity Act 2015
made by this
19
Schedule, sections 580 to 589 of that Act, as in force immediately
20
before the commencement of this item, continue to apply on and after
21
that commencement in relation to the making of a record, disclosure or
22
use of protected information before that commencement.
23
(3)
Despite the repeal of section 590 of the
Biosecurity Act 2015
by this
24
Schedule, that section, as in force immediately before the
25
commencement of this item, continues to apply on and after that
26
commencement in relation to a year ending before that commencement.

(1) The Agriculture Minister or the Health Minister may, on behalf of

the Commonwealth, make, vary or administer an arrangement for
13
the making of payments by the Commonwealth, or make, vary or
14
administer a grant of financial assistance, in relation to one or more
15
of the following:
16
(a) activities or research relating to identifying, preventing,
17
preparing for or managing biosecurity risks;
18
(b) activities in or outside Australian territory relating to dealing
19
with the risk covered by subsection (2), including, but not
20
limited to, improving the capacity of foreign countries to
21
respond to or manage that risk;
22
(c) activities relating to communicating information in or outside
23
Australian territory about the identification of, prevention of,
24
preparation for or management of:
25
(i) biosecurity risks; or
26
(ii) the risk covered by subsection (2);
27
(d) activities relating to supporting or enhancing State or
28
Territory or industry-led biosecurity incident response
29
programs, or biosecurity incident recovery programs, dealing
30
with biosecurity risks;
31
(e) activities relating to identifying or managing established
32
pests or established diseases to stop the spread of such pests
33
or diseases;

(i) entering a foreign country or a part of a foreign country;

(ii) emerging, establishing itself or spreading in a foreign

(b) the potential for any of the following:

(i) the disease or pest to cause harm to human, animal or
11
plant health in that foreign country;
12
(ii) the disease or pest to cause harm to the environment in

that foreign country;

(iii) economic consequences in that foreign country

associated with the entry, emergence, establishment or
16
spread of the disease or pest as mentioned in
17
paragraph (a).

Reimbursement of costs or expenses

(3) An arrangement under subsection (1) may provide for the
20
Commonwealth to reimburse, or partly reimburse, costs or
21
expenses.

(4) A grant under subsection (1) may be made by way of the
23
reimbursement, or partial reimbursement, of costs or expenses.
24
(5) Subsections (3) and (4) do not limit subsection (1).

614C Terms and conditions for grants

Grant of financial assistance to a State or Territory
2
(1) For a grant of financial assistance under section 614B to a State or
3
Territory, the terms and conditions on which that financial
4
assistance is granted are to be set out in a written agreement
5
between the Commonwealth and the State or Territory.
6
(2) The Agriculture Minister or the Health Minister may, on behalf of
7
the Commonwealth, enter into an agreement under subsection (1).
8
(3) Any variation of the grant must be in accordance with the terms or
9
conditions of the grant.
10
Grant of financial assistance to other persons
11
(4) For a grant of financial assistance under section 614B to a person
12
other than a State or Territory, this section does not, by
13
implication, prevent the grant from being made subject to terms
14
and conditions.

614D Additional operation of this Part

(1) In addition to Part 3 of Chapter 1, this Part also has effect as

provided by this section.

(1) The Director of Biosecurity may approve the payment of a

reasonable amount of compensation under this section in respect of

goods if:

(a) in accordance with subsections 634(1A) and (1B), a claim for

compensation is made to the Director alleging that the goods
12
have been damaged by a person in the course of performing
13
functions or duties, or exercising powers, under this Act or
14
by a biosecurity industry participant; and
15
(b) the Director is satisfied that the circumstances of the alleged
16
damage are circumstances in relation to which it may be
17
appropriate to give such an approval; and
18
(c) the Director is satisfied that the goods have been damaged by
19
a person in the course of performing functions or duties, or
20
exercising powers, under this Act or by a biosecurity industry
21
participant; and
22
(d) in a case where the Director is satisfied that the goods have
23
been damaged by a biosecurity industry participant--the
24
Director is satisfied that the damage occurred solely:
25
(i) as a result of the biosecurity industry participant
26
complying with a direction given to the biosecurity
27
industry participant under this Act by a biosecurity
28
officer, the Director, the Director of Human Biosecurity,
29
the Agriculture Minister or the Health Minister; or
30
(ii) as a result of the biosecurity industry participant
31
complying with a condition to which the approved
32
arrangement concerned is subject.

Even if the Director of Biosecurity does not approve the payment of a

reasonable amount of compensation under this section, the owner of
5
the goods may be entitled to compensation under section 27
6
(compensation for acquisition of property).

(1A) In deciding whether to give the approval, the Director of
8
Biosecurity may have regard to the following matters:
9
(a) the nature and extent of the damage;
10
(b) the circumstances in which the damage occurred;
11
(c) the condition of the goods before the damage occurred;
12
(d) whether the goods were subject to biosecurity control at the
13
time the damage occurred;
14
(e) whether a biosecurity industry participant was in possession
15
or control of the goods at the time the damage occurred;
16
(f) whether the actions or omissions of any person, including the
17
claimant, caused, or contributed to, the damage;
18
(g) any evidence provided by the claimant in relation to a matter
19
covered by paragraph (a), (b), (c), (d), (e) or (f);
20
(h) any other matter the Director considers relevant.

appropriate to give such an approval; and

(c) the Director is satisfied that the goods, conveyances or

premises comprising buildings or other structures have been
5
destroyed by a person in the course of performing functions
6
or duties, or exercising powers, under this Act or by a
7
biosecurity industry participant; and
8
(d) in a case where the Director is satisfied that the goods,
9
conveyances or premises comprising buildings or other
10
structures have been destroyed by a biosecurity industry
11
participant--the Director is satisfied that the destruction
12
occurred solely:
13
(i) as a result of the biosecurity industry participant
14
complying with a direction given to the biosecurity
15
industry participant under this Act by a biosecurity
16
officer, the Director, the Director of Human Biosecurity,
17
the Agriculture Minister or the Health Minister; or
18
(ii) as a result of the biosecurity industry participant
19
complying with a condition to which the approved
20
arrangement concerned is subject.

Claims for compensation
12
(1A) Any claim for compensation must be made by or on behalf of an
13
owner of the compensable item before the end of:
14
(a) the period of 12 months beginning on the day on which the
15
damage or destruction occurred, unless paragraph (b) applies;
16
or
17
(b) if, when the damage or destruction occurred, the owner did
18
not know that the damage or destruction had occurred--the
19
period of 12 months beginning on:
20
(i) the day on which the owner became aware of the
21
damage or destruction, unless subparagraph (ii) applies;
22
or
23
(ii) if the day on which the owner would have become
24
aware of the damage or destruction if the owner had
25
exercised due diligence is earlier than the day referred
26
to in subparagraph (i)--that earlier day.
27
(1B) A claim for compensation under subsection (1A) must:
28
(a) if a form is approved in an instrument under
29
subsection (1C)--be in that form; and
30
(b) be accompanied by the documents (if any) prescribed by the
31
regulations; and
32
(c) specify the compensable item; and
33
(d) specify the day on which the owner became aware of the
34
damage or destruction; and
