1 Short title

This Act may be cited as the Building Energy Efficiency Disclosure
6
Amendment Act 2014.

2 Commencement

This Act commences on 1 July 2015.

13 Building energy efficiency certificates--applications

(1) In this Act:

start day, in relation to a building energy efficiency certificate for a
23
building or an area of a building, means:
24
(a) the issue day for the certificate; or
25
(b) a later day specified in the certificate as the start day.
26
(2) A person may apply to an issuing authority for a building energy
27
efficiency certificate for a building or an area of a building.

(3) The application must:
1
(a) be in writing, in a form approved by the Secretary; and
2
(b) include the following:

(i) an energy efficiency rating for the building (or the
4
building in which the area is located);
5
(ii) a lighting energy efficiency assessment for the building
6
or the area;
7
(iii) the start day the person seeks; and
8
(c) meet any other requirements determined by the Secretary
9
under subsection (6).
10
(4) The energy efficiency rating must satisfy one of the following
11
conditions:
12
(a) the rating was worked out by an accredited assessor by
13
applying the assessment methods and standards determined
14
under section 21;
15
(b) an auditing authority:
16
(i) provided or approved the rating; and
17
(ii) is satisfied that the rating was worked out by applying
18
the assessment methods and standards determined under
19
section 21.
20
(5) The lighting energy efficiency assessment must satisfy one of the
21
following conditions:
22
(a) the assessment was performed by an accredited assessor by
23
applying the assessment methods and standards determined
24
under section 21;
25
(b) an auditing authority:
26
(i) provided or approved the assessment; and
27
(ii) is satisfied that the assessment was performed by
28
applying the assessment methods and standards
29
determined under section 21.
30
(6) The Secretary may, by legislative instrument, make a
31
determination for the purposes of paragraph (3)(c).

13A Building energy efficiency certificates--issue
1
(1) An issuing authority may, on application under section 13, issue a
2
building energy efficiency certificate for a building or an area of a
3
building if the issuing authority is satisfied that:
4
(a) the application meets the requirements of subsections 13(3),
5
(4) and (5); and
6
(b) the energy efficiency rating is appropriate for the building (or
7
the building in which the area is located), applying the
8
methods and standards determined under section 21; and
9
(c) the lighting energy efficiency assessment is appropriate for
10
the building or the area, applying the methods and standards
11
determined under section 21.
12
(2) The certificate must set out the following:
13
(a) the energy efficiency rating for the building (or the building
14
in which the area is located);
15
(b) the lighting energy efficiency assessment for the building or
16
the area;
17
(c) the start day for the certificate (which may be different from
18
the start day sought by the applicant);
19
(d) the period for which the certificate is current;
20
(e) any other information determined by the Secretary under
21
subsection (4).
22
(3) For paragraph (2)(d), the period set out in the certificate must be a
23
period of no more than 12 months beginning on the start day set
24
out in the certificate.
25
(4) The Secretary may, by legislative instrument, make a
26
determination for the purposes of paragraph (2)(e).

17 Exemptions on application

Application for an exemption
11
(1) A person may apply to the Secretary for a building or an area of a
12
building to be exempt from the operation of section 11, 12 or 15.
13
(2) The application must:
14
(a) be in writing in a form approved by the Secretary; and
15
(b) include information of a kind prescribed by regulation; and
16
(c) be accompanied by the fee (if any) prescribed by regulation.

Granting an exemption
18
(3) The Secretary may grant the exemption:
19
(a) if the Secretary is satisfied that the building or the area is
20
used for police or security operations; or
21
(b) if the Secretary is satisfied that the building or the area is
22
non-assessable (see subsections (7) and (8)); or
23
(c) in circumstances prescribed by regulation for the purposes of
24
this paragraph.
25
(4) The Secretary must give the applicant written notice of the
26
Secretary's decision under subsection (3).

Varying or revoking an exemption
1
(5) The Secretary may vary or revoke an exemption by giving notice
2
in writing to:
3
(a) the applicant; and
4
(b) any other person whose interest in the building or the area is
5
registered with a land titles office (however described).
6
(6) Subsection (5) does not limit subsection 33(3) of the Acts
7
Interpretation Act 1901.

Meaning of non-assessable
9
(7) A building is non-assessable if it is not possible to work out an
10
energy efficiency rating for the building, or perform a lighting
11
energy efficiency assessment for the building, because of the
12
characteristics of the building.
13
(8) An area of a building is non-assessable if it is not possible to work
14
out an energy efficiency rating for the building in which the area is
15
located, or perform a lighting energy efficiency assessment for the
16
area, because of the characteristics of the building or the area.
17
17A Automatic exemptions
18
A building or an area of a building is exempt from the operation of
19
section 11, 12 or 15 if circumstances specified in a determination
20
under paragraph 21(1)(d) apply to the building or the area.

(iv) the documentation and record keeping of accredited

assessors and other persons in relation to such ratings,

assessments and applications; and

(b) supervise ratings and assessments by accredited assessors to
11
ensure that:

(i) the assessment methods and standards determined under
13
section 21 are properly applied; and
14
(ii) the ratings and assessments are properly documented;
15
and
16
(iii) the records of ratings and assessments are properly kept.

(3A) Without limiting subsection (3), an auditor may conduct an audit of
18
a rating, assessment or application by doing no more than
19
reviewing documents relating to the assessment, rating or
20
application.

60 Application of amendments

The amendments of the Building Energy Efficiency Disclosure Act 2010

made by Part 1 of this Schedule apply in relation to the following:
4
(a) an offer to enter into a contract made on or after the
5
commencement of this Schedule;
6
(b) an invitation to make such an offer made or continued on or
7
after the commencement of this Schedule;
8
(c) an application for a building energy efficiency certificate
9
made under section 13 of that Act on or after the
10
commencement of this Schedule, and the issue of a certificate
11
on such an application;
12
(d) a building energy efficiency certificate issued as mentioned
13
in paragraph (c);
14
(e) in the case of the amendment of section 14 of that Act (the
15
Building Energy Efficiency Register)--a building energy
16
efficiency certificate, or an exemption under section 17,
17
issued or granted before, on or after the commencement this
18
Schedule;
19
(f) an application for an exemption made under section 17 of
20
that Act on or after the commencement of this Schedule, and
21
the grant, variation or revocation of such an exemption;
22
(g) an exemption granted as mentioned in paragraph (f);
23
(h) the exercise of a power under section 18 of that Act
24
(information gathering) on or after the commencement of this
25
Schedule;
26
(i) an infringement notice given to a person under section 58 of
27
that Act on or after the commencement of this Schedule.

This Schedule commences on 1 July 2015 (see section 2).

61 Saving
--recognition of issuing authority before

commencement

Despite the repeal of section 13 of the Building Energy Efficiency
32
Disclosure Act 2010 by Part 1 of this Schedule, an issuing authority
33
recognised under that section immediately before the commencement of
34
this Schedule is taken to continue to be recognised under that section on
35
and after that time for all purposes in relation to:

(a) considering an application for a building energy efficiency
