1 Short title

This Act is the
Environment Protection and Biodiversity
6
Conservation Amendment (Standards and Assurance) Act 2021
.

2 Commencement
8
(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10
column 2 of the table. Any other statement in column 2 has effect
11
according to its terms.

(2) The Minister may enter into a bilateral agreement declaring that

actions assessed in a specified manner need not be assessed under

Part 8 only if the Minister is satisfied that:

(a) assessment of an action in the specified manner will include

assessment of the impacts the action has or will have, or is
18
likely to have, on each matter protected by a provision of
19
Part 3; and
20
(b) if there are one or more national environmental standards--
21
assessment of an action in the specified manner will not be
22
inconsistent with those standards.

the bilaterally accredited authorisation process concerned.

the Environment Minister may give the appropriate Minister of the
24
State or Territory a written notice described in subsection (2) or
25
(3).

65B Simplified outline of this Part
5
The Minister may make national environmental standards. There
6
are to be regular reviews of the standards.
7
Certain decisions or things under this Act must not be inconsistent
8
with a standard. There are exceptions for decisions made or things
9
done in the public interest.

Division 2--National environmental standards

65C Making national environmental standards
12
(1) The Minister may, by legislative instrument, make standards for
13
the purposes of this Act.
14
Note:
Certain decisions or things under this Act must not be inconsistent
15
with the standards: see Division 3.
16
Commencement of standards
17
(2) A standard commences on the day specified in the standard, which
18
must be at least 1 month, but not more than 6 months, after the day
19
on which the standard is made.

No disallowance of first standards
21
(3) Section 42 (disallowance) of the
Legislation Act 2003
does not
22
apply to each of the first standards made under this section in
23
relation to a particular matter.

Incorporation of other instruments
1
(4) Despite subsection 14(2) of the
Legislation Act 2003
, a standard
2
under this section may make provision in relation to a matter by
3
applying, adopting or incorporating, with or without modification,
4
any matter contained in an instrument or other writing:
5
(a) as in force or existing at a particular time; or
6
(b) as in force or existing from time to time;
7
even if the instrument or other writing does not yet exist when the
8
standard is made.

65D Varying and revoking national environmental standards
10
(1) The Minister may, by legislative instrument, vary or revoke a
11
national environmental standard.
12
(2) A variation commences on the day specified in the variation, which
13
must be not more than 6 months after the day on which the
14
variation is made.
15
Incorporation of other instruments
16
(3) Despite subsection 14(2) of the
Legislation Act 2003
, a variation
17
under this section may make provision in relation to a matter by
18
applying, adopting or incorporating, with or without modification,
19
any matter contained in an instrument or other writing:
20
(a) as in force or existing at a particular time; or
21
(b) as in force or existing from time to time;
22
even if the instrument or other writing does not yet exist when the
23
variation is made.

65E Standards etc. may deal with transitional arrangements
25
(1) A national environmental standard made under section 65C, or a
26
variation under section 65D of such a standard, may specify the
27
circumstances in which the standard or variation does not apply in
28
relation to a decision or thing covered by subsection 65H(1).
29
(2) Without limiting subsection (1), the circumstances may relate to
30
one or more processes begun before the commencement of the
31
standard or variation.

65F Notifying States and Territories of national environmental

standards
2
(1) If the Minister (the
Environment Minister
) makes, varies or
3
revokes a national environmental standard, the Environment
4
Minister must notify, in writing, the appropriate Minister of a State
5
or Territory that is party to a bilateral agreement of the making,
6
variation or revocation.
7
(2) For the making or variation of a national environmental standard,
8
the notification must request that the appropriate Minister of the
9
State or Territory advise, in writing, the Environment Minister of
10
whether:
11
(a) any bilaterally accredited management arrangement, or any
12
bilaterally accredited authorisation process, for the purposes
13
of the agreement is inconsistent with the standard or the
14
standard as varied; and
15
(b) any assessment of an action, covered by a declaration
16
referred to in subsection 47(1), in the manner specified in the
17
agreement will be inconsistent with the standard or the
18
standard as varied.
19
(3) Subsection (2) does not apply in relation to a variation of a national
20
environmental standard if the Environment Minister is satisfied
21
that the variation is minor.

65G Reviews of national environmental standards
23
(1) The Minister must cause reviews to be undertaken of each national
24
environmental standard.
25
Timing of reviews
26
(2) The first review must be undertaken within 2 years of the standard
27
commencing.
28
(3) Later reviews must be undertaken at intervals of not more than 5
29
years.

(4) The persons undertaking the review must give the Minister a
2
written report of the review.

Publication

(5) The Minister must cause the report to be published on the
5
Department's website as soon as practicable after the report is
6
given to the Minister.

Division 3--Requirements for decisions or things under
8
this Act
9
65H Requirements for decisions or things under this Act
10
(1) Subject to this Part, a person making a decision, or doing a thing,
11
under this Act, being a decision or thing that is determined in an
12
instrument under subsection (4), must be satisfied that the decision
13
or thing is not inconsistent with a national environmental standard.
14
(2) In considering whether the decision or thing is not inconsistent
15
with a national environmental standard, the person may take into
16
account the following matters:
17
(a) policies, plans or programs of the Commonwealth, a State or
18
self-governing Territory;
19
(b) funding by the Commonwealth, a State or self-governing
20
Territory of activities related to the environment;
21
(c) funding by the Commonwealth, a State or self-governing
22
Territory of activities related to the promotion, protection or
23
conservation of heritage.
24
(3) Subsection (2) does not limit the matters the person may take into
25
account.
26
(4) The Minister may, by legislative instrument, determine a decision
27
or thing for the purposes of subsection (1).

Transitional arrangements
1
(5) An instrument under subsection (4) may specify the circumstances
2
in which subsection (1) does not apply in relation to the making of
3
the decision or the doing of the thing.
4
(6) Without limiting subsection (5), the circumstances may relate to
5
one or more processes begun before the commencement of the
6
instrument.
7
Exception--public interest
8
(7) Subsection (1) does not apply to the making of a decision, or the
9
doing of a thing, by the Minister if:
10
(a) the decision or thing is determined in an instrument under
11
subsection (8); and
12
(b) the Minister is satisfied that the decision or thing is in the
13
public interest.
14
(8) The Minister may, by legislative instrument, determine a decision
15
or thing for the purposes of paragraph (7)(a).
16
(9) If subsection (1) does not apply to the making of a decision, or the
17
doing of a thing, because of subsection (7), the Minister must, as
18
soon as practicable after making the decision or doing the thing,
19
cause a statement to be published on the Department's website
20
setting out the reasons why the Minister is satisfied that the
21
decision or thing is in the public interest.

8 Application provisions

(1)
Paragraph 46(3)(aa) of the
Environment Protection and Biodiversity

on or after the commencement of this item, whether the bilateral
31
agreement was entered into before, on or after that commencement.

Chapter 4 of this Act (about environmental assessments
16
and approvals); and

(c)
monitoring or auditing (or both) the actions taken to
18
monitor compliance with Parts 3, 7 and 9.

The Commissioner must finalise work plans for each financial year
20
setting out the priorities for the Commissioner for that year.

501C Environment Assurance Commissioner's functions
1
(1) The Environment Assurance Commissioner has the following
2
functions:
3
(a) to monitor or audit (or both) the operation of bilateral
4
agreements;
5
(b) to monitor or audit (or both) the processes under this Act in
6
relation to one or more of the following:
7
(i) the making of decisions under Part 7 about whether
8
actions are controlled actions;
9
(ii) the assessment under Part 8 of the relevant impacts of
10
controlled actions;
11
(iii) the approval under Part 9 of the taking of controlled
12
actions;
13
(iv) the assessment under Division 1 of Part 10 of the
14
impacts of actions and the approval under that Division
15
of the taking of actions;
16
(v) the giving of advice under Subdivision A of Division 4
17
of Part 11 in relation to proposals to give authorisations
18
of actions;
19
(c) to monitor or audit (or both) the actions taken to monitor
20
compliance with Parts 3, 7 and 9;
21
(d) to prepare reports on audits referred to in paragraph (a), (b)
22
or (c);
23
(e) any other functions conferred by this Part;
24
(f) any other functions prescribed by the regulations;
25
(g) to do anything incidental to, or conducive to, the performance
26
of the above functions.

Publication of audit report
28
(2) The Environment Assurance Commissioner must publish each
29
audit report on the internet within 30 business days of the
30
Commissioner completing the report.
31
Limitation
32
(3) This section does not permit the Environment Assurance
33
Commissioner to monitor or audit a single decision.

Request for assistance

(4) The Environment Assurance Commissioner may, in performing the
3
Commissioner's functions, request a person to provide information
4
or documents, or answer questions, if the Commissioner
5
reasonably believes that the person has information or documents
6
relevant to the performance of those functions.

Division 3--Appointment of Environment Assurance

Commissioner and terms and conditions

501D Appointment
10
(1) The Environment Assurance Commissioner is to be appointed by
11
the Governor-General by written instrument, on a full-time basis or
12
a part-time basis.

Note:
The Environment Assurance Commissioner may be reappointed: see
14
section 33AA of the
Acts Interpretation Act 1901
.
15
(2) The Environment Assurance Commissioner holds office for the
16
period specified in the instrument of appointment. The period must
17
not exceed 5 years.
18
(3) A person is not eligible for appointment as the Environment
19
Assurance Commissioner unless the Minister is satisfied that:
20
(a) the person has a high level of expertise in one or more fields
21
relevant to the Commissioner's functions; and
22
(b) the person does not have any interests, pecuniary or
23
otherwise, that conflict or could conflict with the proper
24
performance of the Commissioner's functions.
25
(4) A person cannot be appointed as the Environment Assurance
26
Commissioner for more than 2 terms.

501E Acting appointments
28
The Minister may, by written instrument, appoint a person to act as
29
the Environment Assurance Commissioner:

(a) during a vacancy in the office of the Commissioner (whether
1
or not an appointment has previously been made to the
2
office); or
3
(b) during any period, or during all periods, when the
4
Commissioner:
5
(i) is absent from duty or from Australia; or
6
(ii) is, for any reason, unable to perform the duties of the
7
office.

For rules that apply to acting appointments, see sections 33AB and
9
33A of the
Acts Interpretation Act 1901
.

501F Remuneration
11
(1) The Environment Assurance Commissioner is to be paid the
12
remuneration that is determined by the Remuneration Tribunal. If
13
no determination of that remuneration by the Tribunal is in
14
operation, the Commissioner is to be paid the remuneration that is
15
prescribed by the instrument under subsection (4).
16
(2) The Environment Assurance Commissioner is to be paid the
17
allowances that are prescribed by the instrument under
18
subsection (4).
19
(3) This section has effect subject to the
Remuneration Tribunal Act
20
1973
.
21
(4) The Minister may, by legislative instrument, prescribe:
22
(a) remuneration for the purposes of subsection (1); and
23
(b) allowances for the purposes of subsection (2).

501G Leave of absence
25
Full-time appointment
26
(1) If the Environment Assurance Commissioner is appointed on a
27
full-time basis:
28
(a) the Commissioner has the recreation leave entitlements that
29
are determined by the Remuneration Tribunal; and
30

(b) the Minister may grant the Commissioner leave of absence,
1
other than recreation leave, on the terms and conditions as to

remuneration or otherwise that the Minister determines.

Part-time appointment

(2) If the Environment Assurance Commissioner is appointed on a
5
part-time basis, the Minister may grant the Commissioner leave of
6
absence on the terms and conditions that the Minister determines.

501H Other paid work
8
Full-time appointment
9
(1) If the Environment Assurance Commissioner is appointed on a
10
full-time basis, the Commissioner must not engage in paid work
11
outside the duties of the Commissioner's office without the
12
Minister's approval.
13
Part-time appointment
14
(2) If the Environment Assurance Commissioner is appointed on a
15
part-time basis, the Commissioner must not engage in any paid
16
work that, in the Minister's opinion, conflicts or could conflict with
17
the proper performance of the Commissioner's functions.

501J Disclosure of interests
19
The Environment Assurance Commissioner must give written
20
notice to the Minister of all interests, pecuniary or otherwise, that
21
the Commissioner has or acquires and that conflict or could
22
conflict with the proper performance of the Commissioner's
23
functions.

501K Resignation
25
(1) The Environment Assurance Commissioner may resign the
26
Commissioner's appointment by giving the Governor-General a
27
written resignation.

(2) The resignation takes effect on the day it is received by the
1
Governor-General or, if a later day is specified in the resignation,
2
on that later day.

501L Termination of appointment
4
(1) The Governor-General may terminate the appointment of the
5
Environment Assurance Commissioner:
6
(a) for misbehaviour; or
7
(b) if the Commissioner is unable to perform the duties of the
8
Commissioner's office because of physical or mental
9
incapacity.
10
(2) The Governor-General may terminate the appointment of the
11
Environment Assurance Commissioner if:
12
(a) the Commissioner:
13
(i) becomes bankrupt; or
14
(ii) applies to take the benefit of any law for the relief of
15
bankrupt or insolvent debtors; or
16
(iii) compounds with the Commissioner's creditors; or
17
(iv) makes an assignment of the Commissioner's
18
remuneration for the benefit of the Commissioner's
19
creditors; or
20
(b) if the Commissioner is appointed on a full-time basis:
21
(i) the Commissioner is absent, except on leave of absence,
22
for 14 consecutive days or for 28 days in any 12
23
months; or
24
(ii) the Commissioner engages, except with the Minister's
25
approval, in paid work outside the duties of the
26
Commissioner's office (see subsection 501H(1)); or
27
(c) if the Commissioner is appointed on a part-time basis--the
28
Commissioner engages in paid work that, in the Minister's
29
opinion, conflicts or could conflict with the proper
30
performance of the Commissioner's functions (see
31
subsection 501H(2)); or
32
(d) the Commissioner fails, without reasonable excuse, to
33
comply with section 501J.

501M Other terms and conditions
1
The Environment Assurance Commissioner holds office on the
2
terms and conditions (if any) in relation to matters not covered by
3
this Part that are determined by the Minister.

501N Application of the finance law
5
(1) For the purposes of the finance law (within the meaning of the
6
Public Governance, Performance and Accountability Act 2013
),
7
the Environment Assurance Commissioner is an official (within the
8
meaning of that Act) of the Department.
9
Note:
The Commissioner's responsibilities as an official under the finance
10
law include duties in relation to exercising due care and diligence,
11
acting in good faith and for a proper purpose and not improperly using
12
information or position (see Division 3 of Part 2-2 of the
Public
13
Governance, Performance and Accountability Act 2013
).
14
(2) However, section 29 of the
Public Governance, Performance and
15
Accountability Act 2013
(which deals with the duty to disclose
16
interests) does not apply to the Environment Assurance
17
Commissioner.
18
Note:
Section 29 of that Act does not apply to the Commissioner because the
19
duty is instead imposed on the Commissioner under section 501J of
20
this Act.

24
(1) The Minister must, as soon as practicable before the start of each

financial year, give the Environment Assurance Commissioner a
26
written statement of expectations for that year.

Commissioner to prepare work plan

(2) The Environment Assurance Commissioner must prepare and give
29
to the Minister a written work plan for that year. The plan must set
30
out the priorities for the Commissioner for that year.

(3) The Environment Assurance Commissioner must have regard to

the Minister's statement in preparing that plan. This subsection
2
does not limit the matters to which the Commissioner may have
3
regard.

Minister's response

(4) The Minister must:
6
(a) inform the Environment Assurance Commissioner, in
7
writing, that the Minister agrees with the plan; or
8
(b) request the Environment Assurance Commissioner, in
9
writing, to make changes to the plan and include with the
10
request the reasons for the request.

Commissioner to finalise plan
12
(5) The Environment Assurance Commissioner must finalise the plan
13
after receiving the Minister's response under subsection (4) and
14
after having regard to any changes the Minister requests.
15
Commissioner to give Minister copy of plan
16
(6) The Environment Assurance Commissioner must give the Minister
17
a copy of the finalised work plan as soon as practicable after the
18
Commissioner finalises the plan.

Publication

(7) The Environment Assurance Commissioner must publish the
21
following on the internet:
22
(a) the finalised work plan;
23
(b) the statement of expectations;
24
(c) any request under paragraph (4)(b) and the reasons for the
25
request.

The Commissioner must do this as soon as practicable after the

Commissioner finalises the plan.

(1) The Environment Assurance Commissioner may, in writing, vary a

(1) The Minister may, in writing, request the Environment Assurance

Minister, in writing, of the Commissioner's decision on the request

and the reasons for the decision.

501T Assistance from APS employees

The Secretary may make the services of APS employees in the

Department available for the purposes of assisting the Environment

Assurance Commissioner perform the Commissioner's functions.

501U Disclosure of information or provision of documents

(1) The Environment Assurance Commissioner may disclose
20
information, or provide a document, the Commissioner obtains in
21
the course of performing the Commissioner's functions to:
22
(a) the Minister; or
23
(b) the Secretary; or
24
(c) an APS employee in the Department; or
25
(d) a member of a committee established under Part 19 if the
26
Commissioner is satisfied that the information or document
27
will assist the committee to perform its functions; or
28
(e) a member of the Australian Heritage Council if the
29
Commissioner is satisfied that the information or document
30
will assist the Council to perform its functions; or

(1) The Environment Assurance Commissioner must for each financial
7
year:

(a) prepare and give to the Minister, for presentation to the
9
Parliament, a report about the Commissioner's activities
10
during that year; or
11
(b) prepare and give to the Minister a report about the
12
Commissioner's activities during that year, for inclusion in a
13
report (the
overall report
) prepared in relation to the
14
Department and given
to the Minister under section 46 of the
15
Public Governance, Performance and Accountability Act
16
2013
.

(2) The Environment Assurance Commissioner must publish on the

internet the report the Commissioner gives to the Minister. The

(b) if paragraph (1)(b) applies--the overall report referred to in

(1) The Environment Assurance Commissioner may, in writing,

delegate all or any of the Commissioner's functions or powers

under this Part to:

(a) the Secretary; or

(b) an SES employee, or acting SES employee, in the

Department whose services have been made available under

(2)
If the first day of the first term of office of the first Environment

Assurance Commissioner occurs in the first 6 months of a financial

year:

(a) that section, except subsection 501P(1), also applies in
18
relation to the remainder of that financial year; and
19
(b) the Minister must, as soon as practicable after that day, give
20
the Environment Assurance Commissioner a written
21
statement of expectations for the remainder of that financial
22
year.
