The Parliament of Australia enacts:

1 Short title

This Act is the Education Services for Overseas Students (TPS
6
Levies) Amendment Act 2017.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10
column 2 of the table. Any other statement in column 2 has effect
11
according to its terms.

Price Index number that is the weighted average of the 8 capital

cities and is published by the Australian Statistician in relation to

that quarter.

year; and

(b) the amount (a dollar amount) determined in an instrument
26
under section 7A for the purposes of this paragraph for that
27
year, multiplied by the total enrolments for the provider for
28
the previous year.

7 Base fee component

Subject to section 8, a registered provider's base fee component
4
for a year is the sum of:
5
(a) the amount (a dollar amount) determined in an instrument
6
under section 7A for the purposes of this paragraph for that
7
year; and
8
(b) the amount (a dollar amount) determined in an instrument
9
under section 7A for the purposes of this paragraph for that
10
year, multiplied by the total enrolments for the provider for
11
the previous year.

7A Legislative instrument for purposes of section 6 or 7

Calendar year beginning on 1 January 2018
16
(1) Before the calendar year beginning on 1 January 2018, the Minister
17
must, by legislative instrument, do all of the following:
18
(a) determine an amount for the purposes of paragraph 6(a) for
19
that year;
20
(b) determine an amount for the purposes of paragraph 6(b) for
21
that year;
22
(c) determine an amount for the purposes of paragraph 7(a) for
23
that year;
24
(d) determine an amount for the purposes of paragraph 7(b) for
25
that year.

Later calendar years
27
(2) Before the calendar year beginning on 1 January 2019 or a later
28
calendar year, the Minister may, by legislative instrument, do one
29
or more of the following:
30
(a) determine an amount for the purposes of paragraph 6(a) for
31
that year;

(b) determine an amount for the purposes of paragraph 6(b) for
1
that year;
2
(c) determine an amount for the purposes of paragraph 7(a) for

(d) determine an amount for the purposes of paragraph 7(b) for

that year.

Upper limit

(3) The Minister must not determine an amount in an instrument under
8
this section for the purposes of paragraph 6(a) or (b) or 7(a) or (b)
9
for a year that exceeds the following:
10
(a) for paragraph 6(a)--$107;
11
(b) for paragraph 6(b)--$2.15;
12
(c) for paragraph 7(a)--$215;
13
(d) for paragraph 7(b)--$5.38.

Note:
Indexation under section 8 of the dollar amount under paragraph 6(a)
15
or (b) or 7(a) or (b) may result in that amount exceeding the upper
16
limit in this subsection that applies to the Minister's
17
determination-making power.

Having regard to matters
19
(4) In making a legislative instrument under this section, the Minister
20
must have regard to the sustainability of the OSTF.
21
(5) The Minister may also have regard to any other matter he or she
22
considers appropriate.

6 Subsections 8(1) and (2)

Repeal the subsections, substitute:

(1) This section applies for the purpose of working out a dollar amount
26
under paragraph 6(a) or (b) or 7(a) or (b) for the calendar year (the
27
current year) beginning on 1 January 2019 or a later calendar year
28
(the current year) if in the previous year the Minister did not make
29
an instrument under section 7A for the purposes of that paragraph
30
for the current year.

(2) The dollar amount under that paragraph is on 1 January of the
32
current year replaced by the amount worked out using the formula:

(1)
The amendments made by this Schedule apply in relation to working

out the amount of TPS levy under subsection 5(2) or (4) of the
10
Education Services for Overseas Students (TPS Levies) Act 2012 for the
11
calendar year beginning on 1 January 2018 and each later calendar year.

(2)
The amendments made by this Schedule do not affect the continuity of
13
any instrument in force under section 12 of the Education Services for
14
Overseas Students (TPS Levies) Act 2012 immediately before the
15
commencement of this item.
