The Parliament of Australia enacts:

1 Short title
5
This Act may be cited as the Parliamentary Counsel and Other
6
Legislation Amendment Act 2012.

2 Commencement
8
(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10
column 2 of the table. Any other statement in column 2 has effect
11
according to its terms.

(f) the preparing and publishing of Government Notices

Gazettes, including Special and Periodic Gazettes; and
20
(g) functions conferred on the Office (or on First Parliamentary

Counsel) under the Acts Publication Act 1905, the Legislative
22
Instruments Act 2003 and any other laws of the
23
Commonwealth; and
24
(h) with the written approval of the Minister--the provision of
25
assistance to a foreign country in relation to the drafting,
26
printing or publishing of laws of the country or information
27
relating to those laws; and

(i) functions conferred by the regulations; and
29
(j) functions incidental to any of the preceding functions.

(2) The fact that an activity is within the functions of the Office of

Parliamentary Counsel does not of itself exclude other persons or
2
bodies from engaging in the activity. However, directions under
3
section 55ZF of the Judiciary Act 1903 may affect the extent to
4
which other persons or bodies may engage in the activity.

(3) An approval under paragraph (1)(h) is not a legislative instrument.

(4) In this section:
7
laws of the Commonwealth include Acts and subordinate
8
legislation.
9
publishing includes publishing electronically.

subordinate legislation includes:
11
(a) Ordinances, Proclamations, regulations, rules and other
12
legislative instruments made under laws of the
13
Commonwealth; and
14
(b) other instruments that:
15
(i) are made under laws of the Commonwealth; or
16
(ii) have or are given the force of Commonwealth law; or
17
(iii) are otherwise related to, or have effect for the purposes
18
of, laws of the Commonwealth.

16B Charging of fees

(1) The Office of Parliamentary Counsel may, on behalf of the
23
Commonwealth, charge fees for things done in the performance of
24
the Office's functions, other than the functions covered by
25
paragraphs 3(1)(a) and (b).

(2) A fee charged under subsection (1) must not be such as to amount
27
to taxation.

(3) A fee charged under subsection (1):
29
(a) is a debt due to the Office of Parliamentary Counsel, on
30
behalf of the Commonwealth; and

(b) is recoverable by the Office of Parliamentary Counsel, on

behalf of the Commonwealth, in a court of competent
2
jurisdiction.

16C Notional payment of fees by the Commonwealth

(1) The purpose of this section is to ensure that fees under section 16B
5
are notionally payable by the Commonwealth (or parts of the
6
Commonwealth).
7
(2) The Minister responsible for administering the Financial
8
Management and Accountability Act 1997 may give written
9
directions for the purpose of this section, including directions
10
relating to the transfer of amounts within, or between, accounts
11
operated by the Commonwealth.
12
(3) A direction under subsection (2) is not a legislative instrument.

(1)
In this Part:

Secretary means the Secretary of the Department.

(2)
To avoid doubt, a reference in this Part to doing a thing includes a
5
reference to making an instrument.

47 Things done under the Acts Publication Act 1905
7
(1)
If, before the commencement of this item, a thing was done by or in
8
relation to the Secretary under a provision of the Acts Publication Act
9
1905 then, for the purposes of the operation of any law of the
10
Commonwealth on and after the commencement of this item, the thing
11
is taken to have been done by or in relation to the First Parliamentary
12
Counsel under that provision as in force after the commencement of this
13
item.

(2)
Subitem (1) is not to be taken to change the time at which a thing was
15
done by or in relation to the Secretary.

48 Things done under the Legislative Instruments Act 2003

(1)
If, before the commencement of this item, a thing was done by or in
18
relation to the Secretary under a provision of the Legislative Instruments

Act 2003 (or of regulations made under that Act) then, for the purposes

in relation to the First Parliamentary Counsel under that provision as in

provision as in force after the commencement of this item.

Neither subitem (1) nor (2) is to be taken to change the time at which a

thing was done by or in relation to the Secretary or the Department.
