The Parliament of Australia enacts:

1 Short title

This Act is the Product Emissions Standards (Excise) Charges Act
6
2017.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10

column 2 of the table. Any other statement in column 2 has effect

according to its terms.

1. The whole of
this Act
At the same time as the Product Emissions
Standards Act 2017 commences.
However, the provisions do not commence
at all if that Act does not commence.
Note:
This table relates only to the provisions of this Act as originally

enacted. It will not be amended to deal with any later amendments of

this Act.

(2) Any information in column 3 of the table is not part of this Act.

Information may be inserted in this column, or information in it

may be edited, in any published version of this Act.

3 Act binds the Crown

This Act binds the Crown in each of its capacities.

4 Definitions

In this Act:

amount includes a nil amount.
14
emissions-controlled product has the same meaning as in the
15
Product Emissions Standards Act 2017.

manufacture, for a product prescribed for the purposes of the
17
definition of product in the Product Emissions Standards Act 2017,
18
means produce by any method.

5 Imposition of charge

Charge is imposed on the manufacture of emissions-controlled
21
products.

6 Amount of charge
1
The amount of the charge imposed on the manufacture of an

emissions-controlled product is the amount:
3
(a) prescribed by the regulations; or
4
(b) worked out in accordance with a method prescribed by the
5
regulations.

7 Liability for charge
7
Charge imposed on the manufacture of an emissions-controlled
8
product is payable by the person who manufactures the product.
9
8 Regulations
10
The Governor-General may make regulations prescribing matters:
11
(a) required or permitted by this Act to be prescribed; or
12
(b) necessary or convenient to be prescribed for carrying out or
13
giving effect to this Act.
