The Parliament of Australia enacts:

1 Short title
5
This Act is the
Public Governance, Performance and
6
Accountability Amendment (Improved Grants Reporting) Act 2021.

2 Commencement
8
(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10
column 2 of the table. Any other statement in column 2 has effect
11
according to its terms.

It also provides for reporting requirements for certain types of

grants approved under instruments made under section 105C (see
10
section 105CA).

105CA Reportable grants approved under instruments
14
(1) This section applies if a Minister:
15
(a) approves a grant in accordance with an instrument made
16
under section 105C; and
17
(b) the grant is a reportable grant.
18
(2) If the Minister approves a reportable grant, the Minister must
19
provide a written report to the Finance Minister within 30 days of
20
approving the reportable grant.
21
(3) The report must include a statement of reasons that explains the
22
basis on which the Minister approved the reportable grant.
23
(4) If the Minister is a member of the House of Representatives and
24
the Minister approves a reportable grant
for a grantee in their
25
electorate, the Minister must include this information in the
26
statement of reasons in subsection (3).

(5) Subsection (4) does not apply if the reportable grant is awarded

Australia-wide, state-wide or across a region on the basis of a
2
formula, and the reportable grant falls in the relevant Minister's
3
electorate.

(6) The Finance Minister must table a copy of the report in each House
5
of Parliament within 5 sitting days of that House after receiving the
6
report.

(7) In this section:
8
grant
means an arrangement for the provision of financial
9
assistance by the Commonwealth or on behalf of the
10
Commonwealth under which relevant money or other CRF money
11
is to be paid to a grantee other than the Commonwealth, which can
12
be awarded:
13
(a) on the basis of a variety of processes, including the
14
following:
15
(i) a competitive or non-competitive selection process;
16
(ii) where particular criteria are satisfied;
17
(iii) on a one off or ad hoc basis; and
18
(b) for a variety of purposes, including the following;
19
(i) research;
20
(ii) providing for the delivery of services;
21
(iii) helping fund infrastructure;
22
(iv) helping build capacity.
23
reportable grant
means a grant which is approved:
24
(a) based on an application which:
25
(i) an official has recommended should be rejected; or
26
(ii) does not meet any of the relevant selection criteria; or
27
(b) by a Minister, who is a member of the House of
28
Representatives, for a grantee in their electorate.
