The Parliament of Australia enacts:

1 Short title
4
This Act may be cited as the Parliamentary Service Amendment
5
Act 2012.

2 Commencement
7
(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

57 Roles and responsibilities of Secretaries

Roles of Secretaries
7
(1) The roles of the Secretary of a Department include, but are not
8
limited to, the following:
9
(a) principal adviser to the Presiding Officer on matters relating
10
to the Department;
11
(b) leader, providing stewardship within the Department and, in
12
partnership with other Secretaries, across the Parliamentary
13
Service;
14
(c) any other role prescribed by the determinations.
15
Responsibilities of Secretaries
16
(2) The responsibilities of the Secretary of a Department are as
17
follows:
18
(a) to manage the affairs of the Department efficiently,
19
effectively, economically and ethically;
20
(b) to advise the Presiding Officer about matters relating to the
21
Department;
22
(c) to implement measures directed at ensuring that the
23
Department complies with the law;
24
(d) to provide leadership, strategic direction and a focus on
25
results for the Department;
26
(e) to engage with stakeholders, particularly in relation to the
27
core activities of the Department;
28
(f) to manage the affairs of the Department in a way that is not
29
inconsistent with the interests of the Parliamentary Service as
30
a whole;

(g) to assist the Presiding Officer to fulfil the Presiding Officer's

accountability obligations to the Parliament to provide factual

information, as required by the Parliament, in relation to the

operation and administration of the Department;

(h) such other responsibilities as are prescribed by the
5
determinations.

(3) Subsection (2) does not affect a Secretary's responsibilities under
7
any other law.

(2) The function of the SES is to provide strategic leadership of the
4
highest quality that contributes to an effective and cohesive
5
Parliamentary Service.
6
(3) For the purpose of carrying out the function of the SES, each SES
7
employee:
8
(a) provides one or more of the following at a high level:
9
(i) professional or specialist expertise;
10
(ii)
policy
advice;
11
(iii) program or service delivery;
12
(iv) regulatory administration; and
13
(b) promotes cooperation within and between Departments,
14
including to deliver outcomes across Department boundaries;
15
and
16
(c) by personal example and other appropriate means, promotes
17
the Parliamentary Service Values, the Parliamentary Service
18
Employment Principles and compliance with the Code of
19
Conduct.

(6) A person (the delegate) to whom the Merit Protection

Commissioner has delegated powers or functions under

subsection (1AB) is not subject to direction by any person other

than the Merit Protection Commissioner in relation to the

delegate's exercise of the delegated powers or functions.

(7) A power or function that is exercised by an APS employee under a
11
delegation under subsection (1AB) is taken, for the purposes of the
12
Code of Conduct (within the meaning of the Public Service Act
13
1999), to have been exercised by the APS employee in connection

with APS employment (within the meaning of that Act).

(8) In this section:

former senior official means:
17
(a) a person who held, but no longer holds, an office or
18
appointment under an Act; or
19
(b) a person who was, but is no longer, an SES employee, and
20
who does not hold an office or appointment under an Act; or

(c) a person who was, but is no longer, an SES employee within
22
the meaning of the Public Service Act 1999, and who does
23
not hold an office or appointment under an Act.

(5) The Parliamentary Service is non-partisan and provides advice that

is frank, honest, timely and based on the best available evidence.

10A Parliamentary Service Employment Principles

Parliamentary Service Employment Principles
15
(1) The Parliamentary Service is a career-based service that:
16
(a) makes fair employment decisions with a fair system of
17
review; and
18
(b) recognises that the usual basis for engagement is as an
19
ongoing Parliamentary Service employee; and
20
(c) makes decisions relating to engagement and promotion that
21
are based on merit; and
22
(d) requires effective performance from each employee; and
23
(e) provides flexible, safe and rewarding workplaces where
24
communication, consultation, cooperation and input from
25
employees on matters that affect their workplaces are valued;
26
and
27
(f) provides workplaces that are free from discrimination,
28
patronage and favouritism; and
29
(g) recognises the diversity of the Australian community and
30
fosters diversity in the workplace.

Decisions based on merit
1
(2) For the purposes of paragraph (1)(c), a decision relating to
2
engagement or promotion is based on merit if:
3
(a) all eligible members of the community were given a
4
reasonable opportunity to apply to perform the relevant
5
duties; and
6
(b) an assessment is made of the relative suitability of the
7
candidates to perform the relevant duties, using a competitive
8
selection process; and
9
(c) the assessment is based on the relationship between the
10
candidates' work-related qualities and the work-related
11
qualities genuinely required to perform the relevant duties;
12
and
13
(d) the assessment focuses on the relative capacity of the
14
candidates to achieve outcomes related to the relevant duties;
15
and
16
(e) the assessment is the primary consideration in making the
17
decision.

Determinations made by the Presiding Officers may determine the
19
scope or application of the Parliamentary Service Employment
20
Principles (see subsections 11C(2) to (4)).

(b) determining where necessary the scope or application of the

Parliamentary Service Values.

11A Determinations by Presiding Officers about Parliamentary

Service Values

(1) The Presiding Officers may make determinations under section 71
3
in relation to any of the Parliamentary Service Values for the
4
purpose of:
5
(a) ensuring that the Parliamentary Service incorporates and
6
upholds the Parliamentary Service Values; and
7
(b) determining where necessary the scope or application of the
8
Parliamentary Service Values.
9
(2) However, the Presiding Officers must not make determinations for
10
the purposes of subsection (1) in relation to a Parliamentary
11
Service Value unless:
12
(a) the Commissioner has given advice to the Presiding Officers
13
under section 11 in relation to the Parliamentary Service
14
Value; and
15
(b) the Presiding Officers have had regard to that advice in
16
making the determinations.
17
(3) For the purposes of this Act (other than subsection (1)), the
18
Parliamentary Service Values have effect subject to any restrictions
19
in determinations made for the purposes of subsection (1).

Tabling of Commissioner's advice
21
(4) If the Presiding Officers make determinations in relation to any of
22
the Parliamentary Service Values in accordance with this section,
23
the Presiding Officers must cause to be laid before each House of
24
the Parliament a copy of the advice given by the Commissioner
25
referred to in paragraph (2)(a).

employee, or to a person acting on behalf of the

Commonwealth, information that the person knew, or ought

reasonably to have known, was relevant; or

(c) otherwise failed to behave honestly and with integrity;

in connection with the person's engagement as a Parliamentary
25
Service employee.

Note:
If the person is a Parliamentary Service employee at the time a finding
27
referred to in paragraph (2A)(a), (b) or (c) is made in relation to the
28
person, the Secretary of the Department in which the person is
29
employed may impose sanctions on the person as permitted by
30
subsection (1).

Procedures for determining whether Parliamentary Service

employee, or former Parliamentary Service employee, has
2
breached the Code of Conduct etc.

(3) A Secretary must establish written procedures in accordance with
4
this section for determining:
5
(a) whether a Parliamentary Service employee, or a former
6
Parliamentary Service employee, in the relevant Department
7
has breached the Code of Conduct (including by engaging in
8
conduct referred to in subsection (2A)); and
9
(b) the sanction (if any) that is to be imposed under
10
subsection (1) on a Parliamentary Service employee in the
11
relevant Department who is found to have breached the Code
12
of Conduct (including by engaging in conduct referred to in
13
subsection (2A)).

(4)
The
procedures:
15
(a) must comply with basic procedural requirements set out in
16
directions issued by the Commissioner under subsection (6);
17
and
18
(b) must have due regard to procedural fairness.
19
(5) In addition, and without affecting subsection (4), the procedures
20
may be different for:
21
(a) different categories of Parliamentary Service employees or
22
former Parliamentary Service employees; or
23
(b) Parliamentary Service employees, or former Parliamentary
24
Service employees, who:
25
(i) have been convicted of an offence against a
26
Commonwealth, State or Territory law in respect of
27
conduct that is alleged to constitute a breach of the Code
28
of Conduct; or
29
(ii) have been found to have committed such an offence but
30
no conviction is recorded.
31
(6) The Commissioner must, by legislative instrument, issue directions
32
for the purposes of paragraph (4)(a).
33
(7) A Secretary must ensure that the procedures established under
34
subsection (3) are made publicly available.

(8) Procedures established under subsection (3) are not legislative

instruments.

(1) The Merit Protection Commissioner may, for the purposes of

paragraph 48(1)(ca), inquire into and determine whether a
18
Parliamentary Service employee, or a former Parliamentary
19
Service employee, has breached the Code of Conduct if:
20
(a) the Secretary of the Department in which the Parliamentary
21
Service employee, or former Parliamentary Service
22
employee, was employed at the time of the alleged breach
23
requests the Merit Protection Commissioner to do so; and
24
(b) the Merit Protection Commissioner considers it would be
25
appropriate to do so; and
26
(c) the Parliamentary Service employee, or former Parliamentary
27
Service employee, agrees, in writing, to the Merit Protection
28
Commissioner doing so.

Note:
A finding by the Merit Protection Commissioner under this section is
30
reviewable under the Administrative Decisions (Judicial Review) Act
31
1977.

Procedures for inquiry

(2) The Merit Protection Commissioner must establish written
2
procedures for inquiring into and determining whether a
3
Parliamentary Service employee, or a former Parliamentary
4
Service employee, has breached the Code of Conduct (including by
5
engaging in conduct referred to in subsection 15(2A)). The
6
procedures:
7
(a) must comply with basic procedural requirements prescribed
8
by the determinations; and
9
(b) must have due regard to procedural fairness.
10
Note:
The procedures may make different provision for different classes of
11
Parliamentary Service employees or former Parliamentary Service
12
employees (see subsection 33(3A) of the Acts Interpretation Act
13
1901).
14
(3) In addition, and without affecting subsection (2), the procedures
15
may be different for:
16
(a) different categories of Parliamentary Service employees or
17
former Parliamentary Service employees; or
18
(b) Parliamentary Service employees, or former Parliamentary
19
Service employees, who:
20
(i) have been convicted of an offence against a
21
Commonwealth, State or Territory law in respect of
22
conduct that is alleged to constitute a breach of the Code
23
of Conduct; or
24
(ii) have been found to have committed such an offence but
25
no conviction is recorded.
26
(4) The Merit Protection Commissioner must ensure that the
27

had breached the Code of Conduct, but no finding had been

made; or

Subject to subitem (3), the old Parliamentary Service Act (and the

determinations, procedures and other conduct requirements in force for
6
the purposes of that Act) continue to apply at and after the
7
commencement time in relation to the investigation and determination.
8
(3)
If the Parliamentary Service employee is found to have breached the
9
Code of Conduct, the Secretary must determine the sanction (if any) to
10
be imposed on the Parliamentary Service employee in accordance with
11
the procedures established under paragraph 15(3)(b) of the new
12
Parliamentary Service Act. For that purpose, a reference to the Code of
13
Conduct in those procedures is to be read as a reference to the old Code
14
of Conduct.

10 Finding by Secretary of breach of Code of Conduct but no
16
sanction imposed
17
(1)
This item applies if, before the commencement time, a Secretary had
18
found that a Parliamentary Service employee in the relevant Department
19
had breached the Code of Conduct, but no sanction had been imposed.
20
(2)
The Secretary must determine the sanction (if any) to be imposed on the
21
Parliamentary Service employee in accordance with the procedures
22
established under paragraph 15(3)(b) of the new Parliamentary Service
23
Act. For that purpose, a reference to the Code of Conduct in those
24
procedures is to be read as a reference to the old Code of Conduct.
25
11 Allegation of breach of Code of Conduct by Parliamentary
26
Service employee before commencement time
27
(1)
This item applies if, before the commencement time, an allegation had
28
been made that a Parliamentary Service employee in a Department had
29
breached the Code of Conduct, but the Secretary of that Department had
30
not decided whether to begin an investigation to determine whether the
31
Parliamentary Service employee had breached the Code of Conduct.
32
(2)
This item also applies if:
33
(a) after the commencement time, an allegation is made that:

an inquiry into an alleged breach of the Code of Conduct by

the Commissioner for the purpose of paragraph 48(1)(b) of

the old Parliamentary Service Act, but had not begun the
23
inquiry.

(2)
The old Parliamentary Service Act (and the determinations and other

conduct requirements in force for the purposes of that Act) continue to

apply at and after the commencement time in relation to the inquiry.

31 Engagement of consultants

(1)
The amendment of section 40 of the Parliamentary Service Act 1999

made by item 79 of Schedule 1 to this Act does not affect the

engagement of a consultant by the Commissioner before the
4
commencement time.

(2)
The amendment of section 48 of the Parliamentary Service Act 1999
6
made by item 84 of Schedule 1 to this Act does not affect the
7
engagement of a consultant by the Merit Protection Commissioner
8
before the commencement time.

32 Saving--determinations prescribing penalties for offences
10
against the determinations
11
Determinations in force for the purposes of paragraph 71(2)(c) of the
12
old Parliamentary Service Act continue in force at and after the
13
commencement time as if they were determinations in force for the
14
purposes of subsection 71(2) of the new Parliamentary Service Act.
