2 Commencement

(1) Each provision of this Act specified in column 1 of the table

commences, or is taken to have commenced, in accordance with

column 2 of the table. Any other statement in column 2 has effect

according to its terms.

However, the provisions do not commence

instrument, may be amended or repealed by an instrument made under

1 Definitions

(1)
In this Schedule:
5
PWSS Act
means the
Parliamentary Workplace Support Service Act
6
2023
.

(2)
A term used in this Schedule that is defined for the purposes of the
8
PWSS Act has the same meaning in this Schedule as it has in that Act.
9
2 PWSS may perform functions regardless of when alleged
10
relevant conduct occurs
11
The PWSS may perform a function under section 15, 16 or 19 of the
12
PWSS Act in relation to alleged relevant conduct that occurs before, on
13
or after the commencement of this item.
14
3 Transfer to the PWSS of complaints made before
15
commencement under the existing PWSS mechanism
16
(1)
This item applies if:
17
(a) a complaint was made before the commencement of this item
18
under the existing PWSS mechanism in relation to alleged
19
relevant conduct (within the meaning of the PWSS Act); and
20
(b) the PWSS would have the power to review the complaint
21
under subsection 19(2) of the PWSS Act if it were made to
22
the PWSS on or after that commencement; and
23
(c) before that commencement, either:
24
(i) the complaint had started to be reviewed under the
25
existing PWSS mechanism (whether or not the review
26
had been completed); or
27
(ii) a decision had not been made under that mechanism
28
whether to review the complaint.

(2)
The PWSS must deal with the complaint on and after that
30
commencement as if the complaint had been made to the PWSS under
31
section 19 of the PWSS Act, subject to subitems (3) to (5).

(3)
Any steps taken under the existing PWSS mechanism for the purposes
1
of according a person procedural fairness in relation to the complaint
2
are taken, on and after that commencement, to have been taken by the
3
PWSS.
4
(4)
If, before that commencement:
5
(a) a review of the complaint conducted under the existing
6
PWSS mechanism had been completed; and
7
(b) a decision was made under the existing PWSS mechanism
8
about whether the complaint is upheld;
9
then:
10
(c) the decision is taken, on and after that commencement, to
11
have been made by the PWSS; and
12
(d) if the complaint was upheld:
13
(i) any report of the review completed before that
14
commencement is taken, on and after that
15
commencement, to have been prepared by the PWSS
16
under subsection 19(3) of the PWSS Act; and
17
(ii) any recommendation made before that commencement
18
under the existing PWSS mechanism in relation to the
19
complaint is taken, on and after that commencement, to
20
have been made by the PWSS.

(5)
If a report to which subparagraph (4)(d)(i) applies includes a
22
recommendation to a parliamentarian, then:
23
(a) the PWSS must engage with the parliamentarian under
24
subsection 19(4) of the PWSS Act on and after that
25
commencement in relation to implementing the
26
recommendation; and
27
(b) any engagement by the Parliamentary Service Commissioner
28
with the parliamentarian before that commencement in
29
relation to implementing the recommendation is taken to
30
have been carried out by the PWSS; and
31
(c) if the recommendation is not implemented
--
the PWSS must
32
under subsection 19(5) of the PWSS Act give a copy of the
33
report to the President of the Senate or the Speaker of the
34
House of Representatives (as the case requires).

In this item:

existing PWSS mechanism
means the mechanism established by the

Parliamentary Service Commissioner in accordance with

paragraph 112B(1)(a) of the
Parliamentary Service

Determination 2013
, as in force at any time before the commencement
4
of this item.

4 Transfer of records
6
(1)
Records and documents covered by subitem (2) or (3) are to be
7
transferred to the PWSS after the commencement of this item.
8
(2)
This subitem covers records or documents that were:
9
(a) in the possession of the agency (within the meaning of the
10
Public Service Act 1999
) known as the Australian Public
11
Service Commission immediately before the commencement
12
of this item; and
13
(b) given to, received by, or brought into existence by, that
14
agency for the dominant purpose of the performance of a
15
function that:
16
(i) was conferred on the Parliamentary Service
17
Commissioner by subclause 112B(1) of the
18
Parliamentary Service Determination 2013
before that
19
commencement; and
20
(ii) is to be performed by the PWSS after that
21
commencement.

(3)
This subitem covers records or documents that were:
23
(a) in the possession of the Finance Department immediately
24
before the commencement of this item; and
25
(b) given to, received by, or brought into existence by, that
26
Department for the dominant purpose
of the performance of a
27
function that is to be performed by the PWSS after that
28
commencement.

(4)
In this item:

means the Department administered by the
31
Minister administering the
Public Governance, Performance and
32
Accountability Act 2013
.

5 Confidential information
1
(1)
This item applies to any confidential information given to a person
2
before the commencement of this item for the purpose of the
3
performance of a function that:
4
(a) was conferred on the Parliamentary Service Commissioner
5
by subclause 112B(1) of the
Parliamentary Service
6
Determination 2013
before that commencement; and
7
(b) is to be performed by the PWSS after that commencement.
8
(2)
The information is taken, immediately after that commencement, to
9
have been given to the PWSS.

6 Reports by the PWSS
11
(1)
Subsection 22(2) of the PWSS Act applies in relation to financial years
12
starting on or after 1 July 2024, subject to subitem (2).
13
(2)
Paragraph 22(2)(d) of the PWSS Act applies in relation to financial
14
years starting on or after 1 July 2025.
15
Note:
Paragraph 22(2)(d) of the PWSS Act covers information relating to progress in the
16
prevention of, and responses to, alleged relevant conduct.

7 Use and disclosure of information
18
Part 7 of the PWSS Act applies in relation to the use or disclosure of
19
information by a person on or after the commencement of this item,
20
whether the information was obtained by, or disclosed to, the person
21
before, on or after that commencement.
