A Bill for an Act to impose renewable energy certificate
charge, and for related purposes
The Parliament of Australia enacts:
This Act may be cited as the Renewable Energy (Electricity) (Charge)
Act 2000.
This Act commences at the same time as section 1 of the Renewable
Energy (Electricity) Act 2000.
An expression used in this Act and in the Renewable Energy
(Electricity) Act 2000 has the same meaning in this Act as it has in that
Act.
This Act binds the Crown in right of each of the States, of the
Australian Capital Territory, of the Northern Territory and of Norfolk Island.
However, it does not bind the Crown in right of the Commonwealth.
The charge that is payable under the Renewable Energy (Electricity)
Act 2000 is imposed by this section under the name of renewable energy
shortfall charge.
The rate of charge in relation to the year commencing on
1 January 2001 and all later years is $40 per MWh.
(1) This Act does not impose a tax on property of any kind belonging to a
State.
(2) In this section:
property of any kind belonging to a State has the same
meaning as in section 114 of the Constitution.
