The Parliament of Australia enacts:

1 Short title
5
This Act may be cited as the Road Transport Reform (Dangerous
6
Goods) Repeal Act 2009.

2 Commence ment

(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10
column 2 of the table. Any other statement in column 2 has effect
11
according to its terms.

Royal Assent.

A single day to be fixed by Proclamation.
However, if any of the provision(s) do not
commence with in the period of 6 months
beginning on the day on which this Act
receives the Royal Assent, they commence
on the first day after the end of that period.
Note:
This table relates only to the provisions of this Act as originally

passed by both Houses of the Parliament and assented to. It will not be

expanded to deal with provisions inserted in this Act after assent.

part of this Act. Information in this column may be added to or

pre-commencement offences

(1)
Despite the repeal of the Road Transport Reform (Dangerous Goods)

Act 1995 by this Schedule, that Act continues to apply, in relation to:
4
(a) an offence committed before the commencement of this item;
5
or
6
(b) proceedings for an offence alleged to have been committed
7
before the commencement of this item; or
8
(c) any matter connected with, or arising out of, such
9
proceedings;
10
as if that repeal had not happened.

(2)
Subitem (1) does not limit the operation of section 8 of the Acts
12
Interpretation Act 1901.

3 Transitional

recovery of costs of government action

Despite the repeal of the Road Transport Reform (Dangerous Goods)
15
Act 1995 by this Schedule, section 44 of that Act continues to apply, in
16
relation to an incident that occurred before the commencement of this
17
item, as if that repeal had not happened.

liability for pre-commencement acts and

omissions

Despite the repeal of the Road Transport Reform (Dangerous Goods)
21
Act 1995 by this Schedule, sections 48 and 49 of that Act continue to
22
apply, in relation to an act or omission that occurred before the

commencement of this item, as if that repeal had not happened.

laws of the Australian Capital Territory

To avoid doubt, a law of the Australian Capital Territory may make
26
provision in relation to transitional matters arising out of the repeal of
27
the Road Transport Reform (Dangerous Goods) Act 1995.
