The Parliament of Australia enacts:

1 Short title
5
This Act may be cited as the Social Security and Other Legislation
6
Amendment (Disability Support Pension Participation Reforms)
7
Act 2012.

2 Commencement
9
(1) Each provision of this Act specified in column 1 of the table
10
commences, or is taken to have commenced, in accordance with
11
column 2 of the table. Any other statement in column 2 has effect
12
according to its terms.

(1) This section applies to a person if:
8
(a) the person is receiving disability support pension; and
9
(b) the person would, apart from this section, cease to be
10
qualified for disability support pension because the person
11
obtains paid work that is for:
12
(i) at least 15 hours per week; and
13
(ii) not more than 30 hours per week.
14
(2) A person to whom this section applies continues to be qualified for
15
disability support pension.

If:

(a) before this item commences, the Secretary suspended a
5
person's disability support pension because the person
6
obtained paid work that was for:
7
(i) at least 15 hours per week; and
8
(ii) not more than 30 hours per week; and
9
(b) immediately before this item commences, the suspension is
10
in effect;
11
then:
12
(c) as soon as practicable after this item commences, the
13
Secretary must, for the purposes of section 85 of the Social
14
Security (Administration) Act 1999, reconsider the
15
suspension; and
16
(d) if, having regard to the Social Security Act 1991 as in force
17
on 1 July 2012, the Secretary is satisfied that disability
18
support pension is payable to the person--the Secretary must,
19
under that section, determine that disability support pension
20
is payable to the person; and
21
(e) section 114 of the Social Security (Administration) Act 1999
22
applies to any such determination.

(da) in a case where the following apply:
7
(i) the person is under 35 years of age;
8
(ii) the Secretary is satisfied that the person is able to do
9
work that is for at least 8 hours per week on wages at or
10
above the relevant minimum wage and that exists in
11
Australia, even if not within the person's locally
12
accessible labour market;
13
(iii) if the person has one or more dependent children--the
14
youngest dependent child is 6 years of age or over;
15
the person meets any participation requirements that apply to
16
the person under section 94A; and
17
2 After section 94

94A Participation requirements
20
(1) The participation requirements are as follows:
21
(a) the person must enter into a participation plan when the
22
person is required by the Secretary under section 94B to do
23
so;
24
(b) if a participation plan is in force in relation to the person--
25
the person must enter into another participation plan (instead
26
of the existing one) if required by the Secretary under
27
section 94B to do so;
28
(c) while a participation plan is in force in relation to the person,
29
the person must comply with the requirements in the plan.
30
(2) However, this section does not apply to the person during a period
31
when the person is covered by a participation exemption under
32
section 94C, 94D, 94E or 94F.

94B Participation plans

(1) If a participation plan is not in force in relation to the person, the
2
Secretary may require the person to enter into a participation plan
3
under this section.
4
(2) If a participation plan is in force in relation to the person, the
5
Secretary may require the person to enter into another participation
6
plan instead of the existing one.

Notice of requirement
8
(3) The Secretary is to give the person notice of:
9
(a) the requirement; and
10
(b) the place and time at which the participation plan is to be
11
entered into.

Suitable requirements
13
(4) A participation plan that is in force in relation to a person must
14
contain one or more terms (the requirements) that:
15
(a) the person is required to comply with; and
16
(b) the Secretary regards as suitable for the person.
17
Approval of requirements
18
(5) The requirements in a plan are to be approved by the Secretary.
19
Optional terms
20
(6) A participation plan may also contain one or more terms that the
21
person may, but is not required to, comply with.

Form of plan
23
(7) A participation plan must be in a form approved by the Secretary.

94C Illness or accident
25
(1) A person is covered by a participation exemption if the Secretary is
26
satisfied that the person is temporarily unable to meet the
27
participation requirements because of illness or an accident.

(2) The person is covered by the participation exemption for a period
1
determined by the Secretary.

(3) In deciding whether he or she is satisfied as mentioned in
3
subsection (1), the Secretary may request the person to give the
4
Secretary a certificate from a medical practitioner.
5
(4) Subsection (3) does not limit subsection (1).
6
(5) A determination under subsection (2) is not a legislative
7
instrument.

94D Pre-natal and post-natal relief
9
(1) A pregnant woman is covered by a participation exemption for the
10
period that starts 6 weeks before the woman's expected date of
11
confinement and ends on the day on which the woman gives birth
12
to the child (whether or not the child is born alive).
13
(2) If a woman gives birth to a child (whether or not the child is born
14
alive), the woman is covered by a participation exemption for the
15
period that starts on the day on which she gives birth to the child
16
and ends 6 weeks after that day.

94E Supported employment
18
(1) A person is covered by a participation exemption for a period if:
19
(a) the person is employed throughout the period; and
20
(b) the work undertaken by the person in the course of that
21
employment is for wages set in accordance with the program
22
administered by the Commonwealth known as the supported
23
wage system.
24
(2) A person is covered by a participation exemption for a period if the
25
person is, throughout the period, in employment that is supported
26
by supported employment services within the meaning of section 7
27
of the Disability Services Act 1986.

94F Special circumstances
29
(1) A person is covered by a participation exemption for a period
30
determined by the Secretary if:

(a) the Secretary is satisfied that special circumstances, beyond
1
the person's control, exist; and
2
(b) the Secretary is satisfied that in those circumstances it would
3
be unreasonable to expect the person to meet the participation
4
requirements for that period.
5
(2) The period determined under subsection (1) must not exceed 13
6
weeks.
7
(3) A determination under subsection (1) is not a legislative
8
instrument.

3 Application
10
The amendments made by this Schedule apply for the purposes of
11
working out a person's qualification for disability support pension in
12
respect of days occurring on or after 1 July 2012.

(1) The Secretary may make a written determination that a particular
9
person's maximum portability period for disability support pension
10
is an unlimited period, if all of the following circumstances (the
11
qualifying circumstances) exist:
12
(a) the person is receiving disability support pension;
13
(b) the Secretary is satisfied that the person's impairment is a
14
severe impairment (within the meaning of subsection
15
94(3B));
16
(c) the Secretary is satisfied that the person will have that severe
17
impairment for at least the next 5 years;
18
(d) the Secretary is satisfied that, if the person were in Australia,
19
the severe impairment would prevent the person from
20
performing any work independently of a program of support
21
(within the meaning of subsection 94(4)) within the next 5
22
years.
23
(2) The Secretary must not make a determination under subsection (1)
24
in relation to a person who is outside Australia unless the Secretary
25
is satisfied that:
26
(a) the person is unable to return to Australia because of either of
27
the following events:
28
(i) a serious accident involving the person;
29
(ii) the hospitalisation of the person; and

(b) the person's portability period for disability support pension

had not ended at the time the event occurred.

(3) The Secretary may revoke the determination if any of the
3
qualifying circumstances ceases to exist.

(4) A determination under subsection (1) is not a legislative
5
instrument.

(5) In this section:
7
work means work:
8
(a) that is on wages that are at or above the relevant minimum
9
wage; and
10
(b) that exists in Australia, even if not within the person's locally
11
accessible labour market.
