The Parliament of Australia enacts:

1 Short title

This Act is the Treasury Laws Amendment (Reducing Pressure on
6
Housing Affordability Measures No. 2) Act 2018.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10
column 2 of the table. Any other statement in column 2 has effect
11
according to its terms.

(a) the CGT event happens on or before 30 June 2019; and

(b) you held an ownership interest in the dwelling to which the

CGT event relates throughout the period:

(i) starting just before 7.30 pm (by legal time in the
3
Australian Capital Territory) on 9 May 2017; and
4
(ii) ending just before the CGT event happens.

(2) For the purposes of paragraph (1)(b), treat the ownership interest in
6
the dwelling as having been held by you during a time during
7
which the interest was held by:
8
(a) in relation to sections 118-195 to 118-210 of the Income Tax
9
Assessment Act 1997--the deceased or the trustee of the
10
deceased estate; or
11
(b) in relation to sections 118-215 to 118-230 of that Act--the
12
trustee of the special disability trust.

31 Application of amendments
14
The amendments made by this Part apply in relation to CGT events
15
happening at or after 7.30 pm, by legal time in the Australian Capital
16
Territory, on 9 May 2017.

10 Application of amendments
--general

Subject to item 11 of this Schedule, the amendments of the Foreign
3
Acquisitions and Takeovers Act 1975 made by Part 1 of this Schedule
4
apply in relation to a near-new dwelling acquisition occurring on or
5
after 1 July 2017.

Note:
For the meaning of near-new dwelling acquisition, see subsection 113(4A) of the
7
Foreign Acquisitions and Takeovers Act 1975, as amended by Part 1 of this Schedule.

11 Transitional
--certificate given before commencement
9
(1)
This item applies in relation to a near-new dwelling acquisition if the
10
acquisition:
11
(a) occurred on or after 1 July 2017; and
12
(b) is covered by a residential land (near-new dwelling interests)
13
certificate that was given to a person (the developer) 6
14
months or more before the day this item commenced.
15
(2)
The transitional fee period is the period of 12 months beginning
16
immediately after the developer was given the certificate.
17
(3)
Paragraph (b) of item 1 of the table in subsection 113(1) of the Foreign
18
Acquisitions and Takeovers Act 1975, as amended by Part 1 of this
19
Schedule, has effect as if the paragraph required the developer to pay a
20
fee in relation to the certificate at the end of the transitional fee period.

(4)
Subsection 113(2A) of the Foreign Acquisitions and Takeovers Act
22
1975, as inserted by Part 1 of this Schedule, has effect as if the
23
reference in that subsection to a 6 month period were a reference to the
24
transitional fee period or any subsequent 6 month period (disregarding
25
the definition of 6 month period in subsection 113(3) of that Act).

(1) The object of this section is to increase the discount percentage to

the extent that the

discount capital gain relates to a
*
dwelling used
14
to

provide affordable housing.

When this section applies
16
(2) This section applies to a
*
discount capital gain if:
17
(a) you are an individual; and
18
(b) either:
19
(i) you make the discount capital gain from a
*
CGT event
20
happening in relation to a
*
CGT asset that is your
21
*
ownership interest in a
*
dwelling; or
22
(ii) because of section 115-215, Division 102 applies to you
23
as if you had made the discount capital gain for a
24
*
capital gain of a trust covered by subsection (3); and
25
(c) where subparagraph (b)(ii) applies--the trust's capital gain
26
was made directly, or indirectly through one or more entities
27
that are all covered by subsection (3), from a CGT event
28
happening in relation to a CGT asset that is an ownership
29
interest in a dwelling; and

(d) the dwelling was used to

provide affordable housing on at

least 1095 days:

(i) before the CGT event; and
3
(ii) during your, or the relevant trustee's or partner's,
4

ownership period of that dwelling; and
5
(iii) on or after 1 January 2018.

The days mentioned in paragraph (d) need not be consecutive.

1095 days is the same as 3 years.

(3) This subsection covers the following:

(a) a trust, other than a
*
superannuation fund or a public unit
10
trust (within the meaning of section 102P of the Income Tax
11
Assessment Act 1936);
12
(b) a
*
managed investment trust;
13
(c) a partnership.

(4) The percentage resulting from this section is the sum of:
16
(a) the
*
discount percentage that would apply to the
*
discount
17
capital gain apart from this section; and
18
(b) the result (expressed as a percentage) of subsection (5).

certificate under section 980-15 that covers the dwelling for

the test day; and

(d) no entity is entitled to receive an incentive, under the Scheme

prescribed for the purposes of Part 2 of the National Rental
9
Affordability Scheme Act 2008, for the dwelling for the
10
NRAS year (within the meaning of that Scheme) that
11
includes the test day; and

(e) in the case of a

managed investment trust holding an
13
*
ownership interest in the dwelling on the test day--none of
14
the tenants or occupants of the dwelling on that day holds an
15
interest in the trust that passes the
*
non-portfolio interest test
16
at any time during that day.

980-10 Eligible community housing providers
18
(1) An eligible community housing provider is:
19
(a) an entity registered (however described) under an
*
Australian
20
law as a provider of community housing services; or
21
(b) an entity registered (however described) by an
*
Australian
22
government agency as a provider of community housing
23
services.
24
(2) However, an entity that ceases to be covered by subsection (1)
25
continues to be an eligible community housing provider for the
26
90-day period starting on the day of the cessation.

980-15 Affordable housing certificates
28
For the purposes of paragraph 980-5(c), a certificate must:
29
(a) include a declaration that the
*
eligible community housing
30
provider reasonably believes paragraphs 980-5(a) and (b) to
31
be satisfied for the
*
dwelling for the test day; and
32
(b) be given in the
*
approved form on or before the 31st day after
33
the end of the income year that contains the test day.

Schedule) applies in relation to tenancies starting before, at or after

1 January 2018.

The amendment of subsection 355-65(8) in Schedule 1 to the Taxation

Administration Act 1953 made by this Schedule applies in relation to
5
records and disclosures of information made at or after the
6
commencement of this Schedule, whether the information was obtained
7
before, at or after the commencement of this Schedule.
