A Bill for an Act to
amend the Telecommunications (Carrier Licence
Fees) Act 1991, and for related purposes
The Parliament of Australia enacts:
(1) This Act may be cited as the Telecommunications (Carrier Licence
Fees) Amendment Act 1996.
(2) In this Act, Principal Act means the
Telecommunications (Carrier Licence Fees) Act 1991.
(1) Subject to subsection (2), this Act commences on the day on which it
receives the Royal Assent.
(2) If this Act does not receive the Royal Assent on or before 30 June
1996 it is taken to have commenced on that day.
Each Act that is specified in a Schedule to this Act is amended or
repealed as set out in the applicable items in the Schedule concerned, and any
other item in a Schedule to this Act has effect according to its
terms.
The amendment made by item 1 of Schedule 1 applies in respect only of
fees payable on 1 July 1996 or on 1 July of each succeeding year in respect of a
general telecommunications licence or a public mobile licence.
Despite subsection 48(2) of the Acts Interpretation Act 1901,
regulations made under paragraph 6(b) of the Principal Act may, for the purposes
of determining the amount of the fee payable by carriers on 1 July 1996 under
that Act, be expressed to have commenced at a time not earlier than the
commencement of this Act.
Repeal the paragraph, substitute:
(b) an amount, determined under the regulations, to be the proportion of
the Commonwealth’s contribution to the budget of the International
Telecommunication Union for the calendar year in which that 1 July occurs that
is to be recovered from carriers.
