The Parliament of Australia enacts:

1 Short title
4
This Act may be cited as the Veterans' Entitlements Amendment
5
(2005 Budget Measure) Act 2005.

2 Commencement
7
(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

Each Act that is specified in a Schedule to this Act is amended or

repealed as set out in the applicable items in the Schedule

concerned, and any other item in a Schedule to this Act has effect
10
according to its terms.

1 Section 118PA

Before "A", insert "(1)".

2 Subparagraph 118PA(1)(b)(iii)

Omit "Australia.", substitute "Australia; or".

3 At the end of subsection 118PA(1)

Add:
10
(c) the person is covered by subsection (2) and is in Australia; or
11
(d) all of the following apply to the person:
12
(i) the person is temporarily absent from Australia;
13
(ii) the person has been so for a continuous period not
14
exceeding 13 weeks;
15
(iii) the person was covered by subsection (2) immediately
16
before leaving Australia.

4 At the end of section 118PA
18
Add:
19
(2) A person is covered by this subsection if:
20
(a) the person is the holder of a gold card; and
21
(b) the person has reached qualifying age (within the meaning of
22
section 118OA); and
23
(c) all of the following conditions are satisfied in relation to the
24
person:
25
(i) the person is not eligible for seniors concession
26
allowance under paragraph (1)(a) or (b);
27
(ii) the person is not qualified for seniors concession
28
allowance under the Social Security Act;
29
(iii) the person is not eligible for utilities allowance under
30
this Act;
31
(iv) the person is not qualified for utilities allowance under
32
the Social Security Act.

(3) In this section:

gold card means a card known as the Repatriation Health Card -
2
For All Conditions that evidences a person's eligibility, under this
3
Act or the Military Rehabilitation and Compensation Act 2004, to
4
be provided with treatment for all injuries or diseases.
