The Parliament of Australia enacts:

1 Short title

This Act is the Veterans' Affairs Legislation Amendment
6
(Omnibus) Act 2017.

2 Commencement
8
(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10
column 2 of the table. Any other statement in column 2 has effect
11
according to its terms.

133A Board's objective

In carrying out its functions, the Board must pursue the objective
7
of providing a mechanism of review that:
8
(a) is accessible; and
9
(b) is fair, just, economical, informal and quick; and
10
(c) is proportionate to the importance and complexity of the
11
matter; and
12
(d) promotes public trust and confidence in the decision-making
13
of the Board.

137A Ongoing requirement for lodging material documents with

Board

If:

(a) an application for a review is made under section 135; and
20
(b) before the Board determines the review:

(i) a party to the review obtains possession of a document;

(iii) a copy of the document has not already been lodged
25
with the Board;

the party must, subject to any directions given under
27
subsection 142(2), lodge a copy of the document with the Board as
28
soon as practicable after obtaining possession.

or on behalf of the parties and lodged with the Board; and

(c) the variation or revocation appears appropriate to the Board;

(d) in the case of a variation--the Board is satisfied that it would

decision as varied.

(3) Travelling expenses are not payable in respect of travel outside
5
Australia.

(4) Travelling expenses are not payable unless:
7
(a) the person who has incurred the expenses; or
8
(b) any person approved by that person or by the Review
9
Council;
10
applies in writing to the Review Council for payment and the
11
Review Council approves the application.

(5) The application for payment must be:
13
(a) made within 3 months after the completion of the travel; and
14
(b) accompanied by any document that the applicant considers
15
relevant; and
16
(c) lodged with the Review Council in accordance with the
17
directions of the Convener under section 196ZR.

(6) The Commonwealth is to pay the travelling expenses to which a
19
person is entitled under this section.

(1)
The amendments of sections 196Y and 196Z of the Veterans'

Entitlements Act 1986 made by this Schedule apply in relation to

requests made on or after the commencement of this item.

(2)
The amendment of section 196ZB of the Veterans' Entitlements Act
5
1986 made by this Schedule applies in relation to notices published on
6
or after the commencement of this item.
7
(3)
The amendments of section 196ZN of the Veterans' Entitlements Act
8
1986 made by this Schedule apply in relation to applications made on or
9
after the commencement of this item.

(4)

(2) Without limiting subsection (1), the agreement may make
4
provision for and in relation to the making of payments that are, or
5
the provision of treatment or rehabilitation that is, comparable to
6
payments or treatment or rehabilitation under any of the following:
7
(a) this Act;
8
(b) the Military Rehabilitation and Compensation Act 2004;
9
(c) the Australian Participants in British Nuclear Tests
10
(Treatment) Act 2006.

Provisions of agreement have full effect
12
(3) The provisions of an agreement that is in force under this section
13
have effect despite anything in any of the Acts referred to in
14
subsection (2).

Administration of agreement
16
(4) The Commission, or the Military Rehabilitation and Compensation
17
Commission, may give effect to and administer an agreement that
18
is in force under this section.
19
Variation or revocation of agreement
20
(5) An agreement that is in force under this section may be varied or
21
revoked by the Minister on behalf of the Commonwealth.
22
Publication of agreement
23
(6) The Minister must arrange for a copy of an agreement entered into
24
under subsection (1), or of any variations to such an agreement, to
25
be published on the Department's website.

5 Transitional provisions
27
(1)
An arrangement that:
28
(a) was entered into under section 203 of the Veterans'
29
Entitlements Act 1986 before the commencement of this item
30
(including an arrangement having effect as if it were entered
31
into under that section because of section 56 of the Veterans'
32

Entitlements (Transitional Provisions and Consequential

Amendments) Act 1986); and

Act 1986 as substituted by this Part.

(2)
Subitem (1) does not prevent a variation or revocation, on or after the

commencement of this item, of an arrangement continued in force under

this item.
