Australian National Airlines Amendment Act 1984 No. 68 of 1984 - SECT 7

7. Section 14 of the Principal Act is amended-

   (a)  by omitting paragraph (1) (c) and substituting the following
        paragraph:

''(c) without reasonable excuse, fails to comply with his obligations under
sub-section (2) or (3),''; and

   (b)  by omitting sub-sections (2) and (3) and substituting the following
        sub-sections:

''(2) A Commissioner who has a direct or indirect pecuniary interest in a
matter being considered or about to be considered by the Commission shall, as
soon as possible after the relevant facts have come to his knowledge, disclose
the nature of his interest at a meeting of the Commission.

''(3) A disclosure under sub-section (2) shall be recorded in the minutes of
the meeting of the Commission and the Commissioner shall not, unless the
Commission otherwise determines-

   (a)  be present during any deliberation of the Commission with respect to
        that matter; or

   (b)  take part in any decision of the Commission with respect to that
        matter.

''(3A) For the purpose of the making of a determination by the Commission
under sub-section (3) in relation to a Commissioner who has made a disclosure
under sub-section (2), a Commissioner who has a direct or indirect pecuniary
interest in the matter to which the disclosure relates shall not-

   (a)  be present during any deliberation of the Commission for the purpose
        of making the determination; or

   (b)  take part in the making by the Commission of the determination.''.
