AUSTRALIAN TOURIST COMMISSION ACT 1987 No. 136 of 1987 - SECT 41

Exclusion of Managing Director etc. from certain deliberations
41. (1) The Managing Director shall not be present during any deliberation of
the Board, or take part in any decision of the Board, in relation to:

   (a)  the appointment of a person as Managing Director;

   (b)  the determination or application of any terms and conditions on which
        a person appointed as Managing Director holds office or may be granted
        leave;

   (c)  the termination of the appointment of the Managing Director; or

   (d)  the giving or refusing of approval for the Managing Director to engage
        in paid employment outside the duties of the office.

(2) A person appointed to act as Managing Director shall not be present during
any deliberation of the Board, or take part in any decision of the Board, in
relation to:

   (a)  the appointment of a person as Managing Director or to act as Managing
        Director;

   (b)  the determination or application of any terms and conditions on which
        the Managing Director, or a person appointed to act as
        Managing Director, holds office or may be granted leave;

   (c)  the termination of the appointment of the person or the Managing
        Director; or

   (d)  the giving or refusing of approval for the Managing Director, or a
        person acting as Managing Director, to engage in paid employment
        outside the duties of the office.
