COMPANIES ACT 1981 No. 89 of 1981 - SECT 301
Weight of evidence
301. In ascertaining the weight (if any) to be attached to evidence of
questions and answers admitted under section 300 in any proceedings, regard
shall be had to all the circumstances from which an inference can reasonably
be drawn as to the accuracy or otherwise of the evidence, including-
(a) the recency or otherwise at the time when the examination concerned
took place of any relevant matter dealt with at the examination; and
(b) the presence and nature, or the absence, of any incentive for the
person examined to conceal or misrepresent any relevant matter in his
answers.
