COMPANIES ACT 1981 No. 89 of 1981 - SECT 304
Delegation by inspector
304. (1) An inspector may, either generally or as otherwise provided by the
instrument of delegation, by writing signed by him, delegate to a person any
of his powers or functions under this Part other than this power of
delegation.
(2) The power of delegation conferred on an inspector under sub-section (1)
does not, except in the case of an inspector being a body corporate that is an
authority of a State or Territory, extend to delegating the power to
administer oaths or affirmations or the power to examine on oath or
affirmation.
(3) Any act or thing done in the exercise of a power or the performance of a
function by a person to whom that power or function has been delegated by an
inspector under sub-section (1) has the same force and effect as if it had
been done by the inspector.
(4) A delegate shall, at the request of an officer of a corporation, produce
the instrument of delegation for inspection.
(5) A delegation under this section by an inspector does not prevent the
exercise or performance of a power or function by the inspector.
