CHILD SUPPORT ACT 1988 No. 3 of 1988 - SECT 106
Appellate jurisdiction of Family Court under Act
106. (1) The Family Court has jurisdiction with respect to matters arising
under subsections 44 (2) and (3) and 88 (1) in relation to which:
(a) applications for leave to appeal referred to in section 107 or 110 are
made; and
(b) appeals referred to in section 107 or 110 are instituted.
(2) Subject to section 110, in an appeal under section 107 or 110, the
Family Court shall have regard to the evidence given in the proceedings out of
which the appeal arose and has power to draw inferences of fact and, in its
discretion, to receive further evidence on questions of fact.
(3) The further evidence may be given by affidavit, by oral examination before
the Family Court or a Judge or in such other manner as the Family Court
directs.
