COMMUNITY SERVICES AND HEALTH LEGISLATION AMENDMENT ACT (No. 2) 1989 No. 3 of 1990 - SECT 9

9. (1) Section 13 of the Principal Act is repealed and the following section
is substituted: Applicants who have dependent children

"13. A person is, for the purposes of this Act, to be treated as being a
dependent child of an applicant if, and only if:

   (a)  the person:

   (i)  was born during the period commencing on the date that is the
        prescribed date in relation to the applicant and ending at the
        expiration of the first anniversary of that date; or

   (ii) was under the age of 18 years on that date; and

   (b)  the person has at any time during that period been in the custody,
        care and control of, and ordinarily resident with, the applicant.''.

(2) Section 13 of the Principal Act as in force immediately before the
commencement of this section continues to apply in relation to a person who
is, or who becomes, an applicant and whose prescribed date is earlier than the
commencement of this section.
