CO-OPERATIVE SCHEME LEGISLATION AMENDMENT ACT 1989 No. 92 of 1989 - SECT 77

77. After section 38B of the Principal Act the following section is inserted
in Part III: Qualified privilege

"38C. (1) This section applies where a provision of a relevant Act provides
that a person has qualified privilege in respect of an act, matter or thing.

"(2) The person is not, in the absence of malice on the person's part, liable
to an action for defamation, at the suit of a person, in respect of that act,
matter or thing.

"(3) Neither that provision nor this section limits or affects any right,
privilege or immunity that a person has, apart from that provision or this
section, as defendant in an action for defamation.".
