ENVIRONMENT PROTECTION (SEA DUMPING) ACT 1981 No. 101 of 1981 - SECT 9

9. (1) Where the Minister is satisfied that the law of a State or of the
Northern Territory will, on and after a particular date, make provision for
giving effect to the Convention in relation to the coastal waters of that
State or of the Northern Territory (whether or not the Convention extends to
the whole of those coastal waters), the Minister shall, by notice published in
the Gazette, declare that, on and after that date, this Act does not apply in
relation to the coastal waters of that State or of the Northern Territory, as
the case may be.

(2) Where a declaration is in force under sub-section (1) in relation to the
coastal waters of a State or of the Northern Territory, then, on and after the
date specified in the declaration, a reference in this Act (other than section
17 or 29) to Australian waters or to the sea shall be read as not including a
reference to those coastal waters.

(3) If, at any time on or after the date specified in a declaration in force
under sub-section (1) in relation to the coastal waters of a State or of the
Northern Territory, the Minister is satisfied that the law of the State or of
the Northern Territory, as the case may be, does not make provision for giving
effect to the Convention in relation to those coastal waters, the Minister
may, by notice published in the Gazette, revoke the declaration.
