HEALTH AND OTHER SERVICES (COMPENSATION) ACT 1995 No. 130 of 1995 - SECT 30
Notice of charge suspends liability to pay compensation etc.
30.(1) If an amount is recoverable under section 28 from a compensation payer
in respect of an amount of compensation, the compensation payer is not liable
to pay to the compensable person any amount of the compensation until the
amount is paid to the Commonwealth, or until the end of the 28 day period for
complying with section 28, whichever happens first.
(2) If an amount is recoverable under section 28 from an insurer in respect of
an amount of compensation:
(a) the insurer is not liable to indemnify the compensation payer in
respect of the compensation payer's liability to pay to the
compensable person any amount of the compensation; and
(b) the compensation payer is not liable to pay to the compensable person
any amount of the compensation; until the amount is paid to the
Commonwealth, or until the end of the 28 day period for complying with
section 28, whichever happens first.
