INDUSTRY COMMISSION ACT 1989 No. 9 of 1990 - SECT 15
Notice to person to furnish information and documents
15. (1) Where the Commission:
(a) is holding an inquiry; and
(b) has reason to believe that a person is capable of giving information
or producing documents relevant to the inquiry; the Chairperson, or a
Commissioner nominated to preside at a meeting of a Division of the
Commission constituted for the purposes of the inquiry, may, by notice
in writing served on the person, require the person to send to the
Commission, on or before a day specified in the notice:
(c) a statement, signed by the person, setting out such information as is
so specified; and
(d) such documents as are so specified.
(2) A person must not, without reasonable excuse, refuse or fail to comply
with a notice served under subsection (1).
Penalty: Imprisonment for 6 months or the corresponding fine fixed by
section 4B of the Crimes Act 1914.
(3) It is a reasonable excuse for the purposes of subsection (2) that to send
the statement or document to the Commission might tend to incriminate the
person or make the person liable to forfeiture or a penalty.
