MUTUAL ASSISTANCE IN CRIMINAL MATTERS ACT 1987 No. 85, 1987 - SECT 36

Requests for restraining orders
36. (1) Where:

   (a)  a criminal proceeding has commenced in a foreign country in respect of
        a serious offence;

   (b)  there are reasonable grounds to believe that property that may be made
        or is about to be made the subject of a foreign restraining order is
        located in Australia; and

   (c)  the foreign country requests the Attorney-General to obtain the issue
        of a restraining order under the Proceeds of Crime Act against the
        property; the Attorney-General may, in his or her discretion,
        authorise the DPP to apply to a specified court for the restraining
        order requested by the foreign country.

(2) The court specified shall be the Supreme Court of a State or Territory in
which the property, or some or all of the property, is believed to be located.
