MILITARY REHABILITATION AND COMPENSATION ACT 2004 No. 51, 2004 - SECT 349

Claimant or service chief initiating reconsideration of determinations
(1)
The claimant may request the Commission to reconsider an original determination made by the Commission.

(2)
The claimant may request the Commission to reconsider an original determination made by a service chief.

(3)
The claimant cannot request the Commission to reconsider an original determination if the claimant has made an application to the Board under Part 4 for review of the determination.

(4)
The relevant service chief may request the Commission to reconsider an original determination made by the Commission that relates to liability for a service injury, disease or death of a person who is or was a member of the Defence Force.

(5)
A request must:

(a) be in writing; and
(b) set out the reasons for the request; and
(c) be given to the Commission within 30 days after the day on which notice of the determination was given to the person making the request.

(6)
The Commission may, either before or after the end of that period, extend the period within which the request must be made.

Note: A determination under subsection (6) is not an original determination.
