NATIONAL OCCUPATIONAL HEALTH AND SAFETY COMMISSION ACT 1985 No. 35, 1985 - SECT 34
Termination of appointment
34. (1) The Governor-General may terminate the appointment of the Director of
the Institute by reason of misbehaviour or physical or mental incapacity.
(2) If the Director of the Institute -
(a) becomes bankrupt, applies to take the benefit of any law for the
relief
of bankrupt or insolvent debtors, compounds with his or her creditors
or makes an assignment of his or her remuneration for their benefit;
(b) fails, without reasonable excuse, to comply with section 35;
(c) is absent from duty, except on leave granted by the Minister, for 14
consecutive days or for 28 days in any period of 12 months; or
(d) engages in paid employment outside the duties of the office of
Director
of the Institute without the consent of the Minister, the Governor-General
shall terminate the appointment of the Director of the Institute.
