NATIONAL OCCUPATIONAL HEALTH AND SAFETY COMMISSION ACT 1985 No. 35, 1985 - SECT 40

Appointment, &c., of Commissioner and advisers
40. (1) The Commission shall appoint a person to be a Commissioner for the
purposes of conducting an inquiry and may appoint a person or persons to
advise the Commissioner.

(2) A prescribed officer holds office for such period as is specified in his
or her instrument of appointment.

(3) The Commission may -

   (a)  subject to this Act, determine the terms and conditions of appointment
(including remuneration) of a person holding office as a prescribed
officer; and

   (b)  terminate such an appointment at any time.

(4) Sub-section (3) has effect notwithstanding anything contained in the
Remuneration Tribunals Act 1973.

(5) A person holding office as a prescribed officer may resign the office by
writing signed by the person and delivered to the Commission.
(6) In this section, "prescribed officer" means a Commissioner or an adviser.
