NATIONAL WATER RESOURCES (FINANCIAL ASSISTANCE) ACT 1978 No. 5, 1978 - SECT 10

10. (1) Payment of an amount (including an advance) to a State under this Act
in relation to a project the subject of an agreement is subject to the
following conditions:

   (a)  that the State will, at all reasonable times, permit a person
        authorized by the Minister to inspect and take copies of, or extracts
        from, any plans, designs, tenders, records or other documents relating
        to the project;

   (b)  that there will be furnished to the Minister by the State, as soon as
        practicable after each 30 June and 31 December during the course of
        the project, a progress report on the project as at each of those
        dates;

   (c)  that there will be furnished to the Minister by the State, as soon as
        practicable after the completion of the project, a final report on the
        project; and

   (d)  that, if the Minister informs the Treasurer of the State that he is
        satisfied that the State has failed to fulfil a condition specified in
        paragraph (a), (b) or (c) or in the agreement, the State will repay
        the amount paid to the State under this Act in relation to that
        project, or such part of that amount as the Minister specifies, to the
        Commonwealth.

(2) Payment of an amount (including an advance) to a State under this Act is
subject to the condition that the State will repay to the Commonwealth, on
demand by the Minister for Finance, the amount by which, at the time of the
demand, the total of the amounts paid to the State under this Act exceeds the
total of the amounts that have become payable to the State under this Act.
