PATENTS ACT 1990 No. 83, 1990 - SECT 139

139. (1) The patentee, and any person claiming an interest in the patent as
exclusive licensee or otherwise, are parties to any proceedings under section 
133 , 134 or 138.

(2) In any proceedings under section 133, 134 or 138:

   (a)  the applicant must serve a copy of the application on the
        Commissioner; and

   (b)  the Commissioner may appear and be heard in the proceedings.
